(1) The development shall be begun not later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
(2) The development hereby approved shall be built in accordance with the submitted plan(s) Plan No. 11.041.11 & 11.041.13 received by the Local Planning Authority on 19/08/2011 unless first agreed in writing with the Local Planning Authority. REASON: For the avoidance of doubt.
(3) Deliveries and collections to the premises shall be restricted to the hours of 8:00am and 6:00pm Monday to Friday and 10:30am and 4:30pm Saturday and Sunday. REASON: In the interest of neighbour amenity.
(4) Before any fixed plant and machinery, including refrigeration and air conditioning equipment, is used on the premises it shall be enclosed with sound insulating material and mounted in a way which will minimise transmission of airborne and structure-borne sound in accordance with a scheme to be approved in writing by the local planning authority. REASON: In the interest of neighbour amenity.
(5) All temporary and permanent lighting provided to the proposed development shall be arranged so as not to shine directly towards any dwelling and shall be shielded to prevent light spillage beyond the boundary of the development. REASON: In the interest of neighbour amenity.
(6) All plant, machinery, or extract ventilation (including any fans), should be checked for potential levels of noise emanating from the premises. Any noise emitted from the new units should not contribute any more than 3 dB(A) to existing background noise levels, when measured at a distance of 1 meter from the façade of any adjacent dwelling, and when calculated as an Leq(A) of 10 minutes. REASON: In the interest of neighbour amenity.
(7) External ducting shall discharge 1 metre above eaves level and above any windows. REASON: In the interest of neighbour amenity.
REASON FOR DECISION: The proposed change of use is considered to be acceptable in this location by virtue of the fact that it would not have an adverse affect on the character or amenity of the area. The proposal does not raise any issues in respect of highway safety or crime prevention. The proposal therefore accords with the council’s adopted Development Plan.
NOTE: The following development plan policies were relevant to this decision:- Local Development Framework Policy CS1, CS2, CS3, CS9, CS18, CS19, CS20, DP1, DP2 & DP3.
INFORMATIVE: The applicant should be advised that there is a potential risk of odour and noise problems being generated. To mitigate these potential issues the applicant should make sure that all the equipment specified with the original application is installed and in operation before use of the units commences. The applicant must also make sure that all the recommendations made are implemented and the equipment must be installed by a suitably qualified person and operated in accordance with the manufacturers guidelines.
