|---|---|
(1) The development shall be begun not later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
(2) The development hereby permitted shall be carried out in accordance with the following approved plans: Proposed Plans 01 Rev. A received 3rd August, 2011. Proposed Plans and Elevations 02 received 2nd August, 2011. Section A – A 03 received 2nd August, 2011. REASON: For the avoidance of doubt.
(3) The goods sold from the building hereby approved shall be limited to the retail of flowers and ancillary products grown or imported onto the site, or goods grown in connection with agricultural operations at the site. No other goods within Class A1 of the Use Classes Order shall be sold from the site without the prior written approval of the Local Planning Authority. REASON: The application site lies outside the limits to development and in the open countryside where planning policy restricts development. The application is approved on the basis that the proposal relates to business diversification of a rural enterprise in accordance with adopted planning policy but the Local Planning Authority considers it appropriate to restrict the nature of the goods sold to reflect this policy exception.
(4) A gas membrane shall be installed to a minimum of standard equivalent to gas characteristic situation 2 referenced in CIRIA C655. Following the installation of the gas membrane a validation report must be submitted for Local Authority approval detailing the installation method including photographs of the installation stages. REASON: To ensure that risks from gas seepage to the future users of the land and neighbouring land are minimised.
(5) In the event that contamination is found at any time when carrying out the approved development that was not previously identified it must be reported in writing immediately to the Local Planning Authority. An investigation and risk assessment must be undertaken and where remediation is necessary a remediation scheme must be prepared which is subject to the approval in writing of the Local Planning Authority. Following completion of measures identified in the approved remediation scheme a verification report must be prepared, which is subject to the approval in writing of the Local Planning Authority. If no contamination is found following completion of the development a report must be submitted confirming that unexpected contamination was not encountered during the development. REASON: To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors.
(6) Prior to first use of the building, the loading, unloading, turning space and parking spaces shall be provided in accordance with the scheme as shown on drawing ‘Proposed Plans 01 Rev. A’ and shall be retained for thereafter. REASON: To ensure that there is adequate on-site parking provision to serve the development
(7) Any vehicles visiting the site, including deliveries, must be parked wholly off the Adopted Highway whilst loading or unloading. REASON: In the interests of Highway safety.
(8) Prior to first use of the building and thereafter the dry stone wall fronting Margrove Road shall be reduced in height to 1 metre. REASON: In the interests of Highway safety.
NOTE: The following development plan policies were relevant to this decision:- Local Development Framework Policy - CS2, CS12, CS20, CS22, DP1, DP2, DP3, DP7, DP9, DP11, DP12, DP13, DP17.
INFORMATIVE NOTE: The application site is on/close to land that has been identified as having a history of potential contamination. It is not considered that the development proposed will give rise to 'significant risk' to health or pollution of controlled waters. It is recommended, however, that the attention of the applicant be drawn to the risk of contaminants in, on or under the site.
INFORMATIVE NOTE: The applicant is reminded that it is the responsibility of anybody carrying out building work to ensure mud, debris or deleterious material is not deposited from the site onto the public highway and, if it is, it shall be cleared by that person.
INFORMATIVE NOTE: At no point should the adopted highway be blocked up with out the prior consent of the Councils Highways Maintenance section.
INFORMATIVE NOTE: The applicant is to contact the Council’s Naming & Numbering Officer, Sandra Beaty on 01287 612538, to make arrangements for the correct postal address for the development prior to commencement of any works.
REASON FOR DECISION: The proposed change of use is considered to be acceptable in this location by virtue of the fact that it would not have an adverse affect on the character or amenity of the area. The proposal does not raise any issues in respect of highway safety or crime prevention. The proposal therefore accords with the Council's adopted Development Plan.
