| # | Condition Details |
|---|---|
(1) The development shall be begun not later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
(2) The working hours for all construction activities excepting storage associated with this site shall be limited to between 08:00 and 18:00 Mondays to Friday and 08:00 to 13:00 Saturdays and not at all on a Sunday or Bank Holidays unless otherwise first agreed in writing with the Local Planning Authority. REASON: In the interests of residential amenity.
(3) The contractor’s compound and associated buildings and works hereby permitted shall be removed and the land restored to its former condition on or before 31 May 2012 in accordance with a scheme of work that has first been submitted to and approved in writing by the Local Planning Authority unless the prior consent of the Local Planning Authority has been obtained for an extension to the period of validity. REASON: The development is such that it would not be approved on a permanent basis in this location.
(4) Prior to the commencement of development a traffic management plan shall be submitted to and agreed in writing with the Local Planning Authority. The scheme hereby approved shall then be implemented in accordance with the details provided within the traffic management plan unless first agreed in writing with the Local Planning Authority. REASON: In the interest of highways safety.
(5) Any lighting shall be installed in a manner that ensures that the lighting does not shine directly into adjacent residential properties. REASON: In the interests of residential amenity.
REASON FOR DECISION: Notwithstanding that the site is outside the limits to development within a ‘Restoration Landscape’ due to the locational constraints of the development and the temporary nature of the development it is considered that the proposal would not have along-term detrimental impact upon the environment or the character and appearance of the area. Subject to controls secured by planning condition it is considered that an acceptable balance between the need to provide a compound and the protections of residential amenity can be achieved. The application due to the access arrangements is acceptable in highway terms. Whilst the site may be vulnerable to crime due to locational constraints it is a risk that the developer would have to take. Overall it is considered that the development complies with the aims of Policies CS1, CS2, CS6, CS20, CS22, DP1, DP2 and DP3 of the Redcar and Cleveland Local Development Framework
NOTE: The following development plan policies were relevant to this decision:- Local Development Framework Policy CS1, CS2, CS6, CS20, CS22, DP1, DP2 and DP3.
INFORMATIVE NOTE: The applicant is reminded that it is the responsibility of anybody carrying out building work to ensure mud, debris or deleterious material is not deposited from the site onto the public highway and, if it is, it shall be cleared by that person. Notwithstanding any approved details made under planning provisions, should any noise, odour or other nuisance occur then action may be taken under statutory nuisance provisions. The applicant is advised to contact the Area Management Directorate to arrange a joint condition survey prior to the commencement of development.
