# Condition Details
(1) The development shall be begun not later than the expiration of ONE YEAR from the date of this permission. REASON: The application proposes the conversion of an existing building outside the approved development limits in accordance with Policy DP14 of the adopted Redcar and Cleveland Local Development Framework. The Local Planning Authority considers it appropriate to reduce the time period for the implementation of the scheme in order to secure prompt implementation of the permission and to ensure that development complies with the adopted policy and constitutes conversion of an existing sound building. Whilst there would be no objection in principle to the renewal of this permission should the scheme not be implemented within one year period, subsequent applications may need to be supported by structural surveys to demonstrate that the building is still capable of conversion without substantial demolition and rebuilding.
(2) The development hereby permitted shall be carried out in accordance with the following approved plans: D9998-01 Rev. B received 14th July, 2011 D9998-03.2 Rev. C received 6th September, 2011 D9998-04.2 Rev. E received 6th September, 2011 REASON: For the avoidance of doubt.
(3) Details of the external materials to be used in the carrying out of this permission (including samples) shall be submitted to, and approved in writing by the Local Planning Authority, prior to the commencement of development and the development shall not be carried out except in accordance with the approved details. REASON: To ensure the use of satisfactory materials.
(4) A minimum of two car parking spaces shall be provided within the curtilage of the dwelling prior to first occupation and thereafter retained for parking purposes. The use of permeable, sustainably drained surfacing is recommended. The fall of the new driveway should not discharge any water onto the adjacent adopted highway but drain within curtilage. REASON: To ensure that there is adequate on-site car parking to serve the development.
(5) Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order, 1995, (or any Order revoking or re-enacting that Order) no enlargement of the dwelling the subject of this permission shall be carried out without the express consent of the Local Planning Authority. REASON: To safeguard the character and appearance of the development.
(6) Notwithstanding the provisions of the Town and Country Planning General Development Order, 1995 (or any Order revoking or re-enacting that Order), no fences, gates, walls of any other means of enclosure shall be erected within the curtilage of any dwellinghouse, without the prior written consent of the Local Planning Authority. REASON: To safeguard the character and appearance of the development.
NOTE: The following development plan policies were relevant to this decision:- Local Development Framework Policy - CS2, CS20, CS21, CS22, CS25 DP1, DP2, DP3, DP8, DP11, DP14, DP15.
(7) Notwithstanding the provisions of the Town and Country Planning General Development Order, 1995 (or any Order revoking or re-enacting that Order), no detached buildings shall be erected within the curtilage of the dwelling(s) the subject of this permission, without the express consent of the Local Planning Authority. REASON: To safeguard the character and appearance of the development
(8) Prior to the implementation of the permission granted, a method statement shall be submitted which fully sets out a programme of works and details as to how the planning permission for the approved conversion shall be carried out. The development shall be completed in accordance with that method statement unless otherwise agreed with the Local Planning Authority. REASON: To ensure that the permission to convert the building is implemented in such a manner to preserve the essential character of the building and without the need for any substantial demolition and rebuilding.
INFORMATIVE NOTE: The applicant should be aware that the building is a former Methodist Chapel and as such there is a possibility that human burial may have taken place within the building or in its immediate vicinity. The applicant may wish to carry out additional historical research to investigate this issue. Should human remains be found during development it would be an offence to remove them without appropriate licence. Further information can be obtained from Tees Archaeology: Tees Archaeology, Sir William Gray House, Clarence Road, Hartlepool, TS24 8BT. Tel: 01429 523458.
INFORMATIVE NOTE: Bats and their roosts are protected by law, which means it is illegal to disturb, kill or injure them, or to damage, destroy or obstruct access to a bat roost, whether intentionally or recklessly. As bats tend to return regularly to favoured roosts it is important to remember that roosts are protected whether the bats are present or not. The presence of bats does not mean that operations such as building work, roofing and other repairs, floodlighting or timber treatments cannot take place, but Natural England should be consulted, before work starts to obtain advice.
INFORMATIVE NOTE: The applicant is reminded that it is the responsibility of anybody carrying out building work to ensure mud, debris or deleterious material is not deposited from the site onto the public highway and, if it is, it shall be cleared by that person.
INFORMATIVE NOTE: At no point should the adopted highway be blocked up with out the prior consent of the Councils Highways Maintenance section.
INFORMATIVE NOTE: The applicant is to contact the Council’s Naming & Numbering Officer, Sandra Beaty on 01287 612538, to make arrangements for the correct postal address for the development prior to commencement of any works.
REASON FOR DECISION: The application site is located outside the development limits but takes the form of an existing building of local merit which, it is considered, is capable of conversion without substantial demolition and rebuilding. The application proposes a form of development which is considered to comply with Policy DP14 which permits such conversions subject to satisfying stated criteria. The development will not have an adverse affect on the character or amenity of the area and is of an appropriate design, style and massing. The proposal, therefore, accords with LDF Development Plan Policies CS2, CS20, CS21, CS22, CS25, DP1, DP2, DP3, DP8, DP11 and DP14. There are no issues with regard to public safety, highway safety or crime prevention.
