# Condition Details
1 (1) The proposed development would, due to its location within a local centre where other similar uses exist, result in an unacceptable concentration of such uses exceeding the limit of 5% set out the ‘Interim Policy on Hot Food Takeaways’. No exceptional circumstances have been demonstrated to justify this proposal. It is considered therefore that the proposal would be likely to prejudice the viability and vitality of this local centre contrary to the aims of Redcar and Cleveland Local Development Framework Policy CS18 and ‘Interim Policy on Hot Food Takeaways’.
2 (2) The proposed development would due to its location adjacent to separate residential accommodation at first floor level would create conditions that would be prejudicial to the living conditions of those nearby residential occupiers by way of the activity in and around the premises, particularly during the late evening. The proposal is therefore contrary to the aims of Redcar and Cleveland Local Development Framework Policy DP2 and ‘saved’ Redcar and Cleveland Local Plan 1999 Policy SH7.
