(1) The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
(2) The development hereby approved shall be built in accordance with the amended plan(s) 01-1 received by the Local Planning Authority on 23/02/11 unless first agreed in writing with the Local Planning Authority. REASON: For the avoidance of doubt.
(3) An investigation and risk assessment, in addition to any assessment provided with the planning application, must be completed in accordance with a scheme to assess the nature and extent of any contamination on the site, whether or not it originates on the site. The contents of the scheme are subject to the approval in writing of the Local Planning Authority. The investigation and risk assessment must be undertaken by competent persons and a written report of the findings must be produced. The written report is subject to the approval in writing of the Local Planning Authority. The report of the findings must include: (i) a survey of the extent, scale and nature of contamination; (ii) an assessment of the potential risks to: • human health, • property (existing or proposed) including buildings, crops, livestock, pets, woodland and service lines and pipes, • adjoining land, • groundwaters and surface waters, • ecological systems, • archeological sites and ancient monuments; (iii) an appraisal of remedial options, and proposal of the preferred option(s). This must be conducted in accordance with DEFRA and the Environment Agency’s ‘Model Procedures for the Management of Land Contamination, CLR 11’. REASON : To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors.
(4) All surface and foul water arising from the proposed works must be collected and diverted away from Network Rail property. In the absence of detailed plans all soakaways must be located so as to discharge away from the railway infrastructure. REASON: In the interest of railway safety.
(5) All operations, including the use of cranes or other mechanical plant working adjacent to network rail’s property, must at all times be carried out in a fail safe manner such that in the event of mishandling, collapse or failure, no materials or plant are capable of falling within 3.0m of the nearest rail of the adjacent railway line, or where the railway is electrified, within 3.0m of overhead electrical equipment or supports. REASON: In the interest of railway safety.
(6) All excavations/earthworks carried out in the vicinity of Network Rail property/structures must be designed and executed such that no interference with the integrity of the property/structure can occur. If temporary works compounds are to be located adjacent to the operational railway, these should be included in a method statement for approval by Network Rail. Prior to the commencement of works full details of excavations and earthworks to be carried out near the railway undertakers boundary fence should be submitted for the approval of the local planning authority acting in consultation with the railway undertaker, and the works shall only be carried out in accordance with the approved details. Where development may affect the railway, consultation with the Asset Protection Engineer should be undertaken. REASON: In the interest of railway safety.
(7) Method statements must be submitted to Network Rail’s Asset Protection Engineer for approval prior to the works commencing on the site. Where appropriate an asset protection agreement will have to be entered into. Where any works cannot be carried out in a ‘fail-safe’ manner, it will be necessary to restrict those works to periods when the railway is closed to rail traffic i.e. “possession” which must be booked via Network’s Asset Protection Engineer and are subject to a minimum notice period for booking of 20 weeks. REASON: In the interest of railway safety.
(8) Where new lighting is to be erected adjacent to the railway the potential for train drivers to be dazzled must be eliminated. In addition the location and colour of lights must not give rise to the potential for confusion with signaling arrangements on the railway. Details of any external lighting must be provided to Network Rail, and approved in writing, prior to installation. REASON: In the interest of railway safety.
(9) Before any fixed plant and machinery, including air conditioning equipment is used on the premises it shall be enclosed with sound insulation material and mounted in a way which will minimise transmission of airborne and structure-borne sound in accordance with a scheme to be approved in writing by the local planning authority. REASON: In the interest of the amenity of the area.
(10) All temporary and permanent lighting provided to the development shall be arranged so as not to shine directly towards any dwelling and shall be shielded to prevent light spillage beyond the boundary of the development. Reason: In the interest of the amenity of the area.
INFORMATIVE NOTE: Security of the railway boundary must be maintained at all times. If the works require temporary or permanent alterations to the mutual boundary the applicant must contact Network Rail’s Asset Protection Engineer. INFORMATIVE NOTE: Network Rail’s fence should not be altered or moved in any way and nothing should be put in place which would prevent the maintenance of said boundary fence, as obligated in law. INFORMATIVE NOTE: All roads, paths or ways providing access to any part of the railway undertaker’s land shall be kept open at all times during and after the development. INFORMATIVE NOTE: Network Rail is required to recover all reasonable costs associated with facilitating these works. They can be contacted at: Asset Protection Engineer Team Network Rail (1) Floor 1B George Stephenson House Toft Green York YO1 6JT Email: assetprotectionlne@networkrail.co.uk
NOTE: The following development plan policies were relevant to this decision:- Local Development Framework Policy CS1, CS2, CS5, CS9, CS20, DP1, DP2, DP3 and DP7.
(11) The taxi licensing office shall only be used between the hours of 9am and 9pm Monday-Sunday, and closed at all other times. REASON: In the interest of the amenity of the area.
REASON FOR DECISION: The site is within an area identified for industrial/warehousing purposes. The design and siting of the development takes account of the principles set out in the Council’s supplementary planning guidance. The proposal therefore accords with the Council’s adopted Development Plan.
