# Condition Details
1 (1) The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
2 (2) The development hereby permitted shall be carried out in accordance with the following approved plans: 10242/1A – received 3rd November, 2010. REASON: For the avoidance of doubt.
3 (3) The premises shall not be open to customers outside the following hours:- (09:00 – 18:00) Mondays – Fridays (10:00 – 16:00) Saturdays and Sundays REASON: To safeguard the amenities of residential properties.
4 (4) The use hereby permitted shall be discontinued and the building restored to its former condition on or before 1st JUNE, 2012 unless the prior consent of the Local Planning Authority has been obtained for an extension to the period of validity. REASON: The development is such that it may affect residential amenity and may not be suitable on a permanent basis in this location.
5 Informative Note: Notwithstanding any approved details made under planning provisions, should any noise, odour or other nuisance occur then action may be taken under statutory nuisance provisions.
6 Informative Note: The applicant is to contact the Council’s Naming & Numbering Officer, Sandra Beaty on 01287 612538, to make arrangements for the correct postal address for the development prior to commencement of any works.
7 REASON FOR DECISION: The proposed change of use is considered to be acceptable in this location by virtue of the fact that it would not have an adverse affect on the character or amenity of the area. The proposal does not raise any issues in respect of highway safety or crime prevention. The proposal therefore accords with the Council’s adopted Development Plan.
8 NOTE: The following development plan policies were relevant to this decision:- Local Development Framework Policy CS20, DP2 and DP3.
