# Condition Details
1 (1) The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
2 (2) Full details of the external materials and hard surfaces to be used in the carrying out of this permission (including samples) shall be submitted to, and approved in writing by the Local Planning Authority, prior to the commencement of development (excepting demolition) and the development shall not be carried out except in accordance with the approved details. REASON: To ensure the use of satisfactory materials.
3 (3) Prior to the commencement of development, details shall be submitted to and agreed in writing by the Local Planning Authority, of proposals to provide contractors car parking and material storage within the site. The details approved shall be retained for use until completion of the development unless first agreed in writing with the Local Planning Authority. REASON: In the interest of highways safety.
4 (4) The working hours for all construction activities (including deliveries) on this site are limited to between 08:00 and 18:00 Mondays to Friday and 08:00 to 13:00 Saturdays and not at all on a Sunday or Bank Holidays. REASON: In the interest of neighbour amenity.
5 (5) Prior to the commencement of development a scheme for preventing the deposition of mud/debris on the highway shall be submitted to and approved in writing by the Local Planning Authority. The approved scheme shall be implemented in its entirety and adhered to for the lifetime of the construction period. REASON: In the interests of highway safety
6 (6) Prior to the commencement of development (excepting demolition) a traffic management plan shall be submitted to and agreed in writing with the Local Planning Authority. The scheme should identify the site access. The scheme hereby approved shall then be implemented in accordance with the details provided within the traffic management plan unless first agreed in writing with the Local Planning Authority. REASON: In the interest of highways safety
7 (7) Prior to the commencement of development (excepting demolition) revised highway drainage details should be submitted to the Local Planning Authority for approval in writing. The approved details shall be fully implemented unless otherwise first agreed in writing with the Local Planning Authority. REASON: full details have not been submitted with the application.
8 (8) Any external lighting should be shielded to prevent light spillage beyond the boundary of the site. REASON: In the interests of amenity.
9 (9) There shall be no burning of waste materials at this site. REASON: In the interests of amenity.
10 (10) Full details of the street furniture to be used in the carrying out of this permission shall be submitted to, and approved in writing by the Local Planning Authority, prior to their installation on site and the development shall not be carried out except in accordance with the approved details. REASON: In the interests of the appearance of the scheme.
11 (11) Prior to commencement of any development works (with the exception of the demolition) on the site, the new road alignment and junction shall be subject to a Stage 1 & 2 Road Safety Audit. The Audit shall be carried out in accordance with DMRB HD19/03 and shall be submitted to and approved in writing by the local planning authority. REASON: In the interests of safety and the free flow of traffic on The Esplanade and its surrounding streets and junctions.
12 (12) The new road alignment and junction, (as set out in the above condition) shall be completed to the satisfaction of the local planning authority prior to its use as a highway. The proposed works shall be subject to a Stage 3 (completion of construction) Road Safety Audit. The Audit shall be carried out in accordance with DMRB HD19/03 and shall be submitted to and approved in writing by the local planning authority. REASON: In the interests of safety and the free flow of traffic on The Esplanade and its surrounding streets and junctions.
13 (13) Any generators used at this site shall be acoustically enclosed or silenced. REASON: In the interests of residential amenity.
14 INFORMATIVE: The developer will need to contact the Highway Authority with regard to changing the status of the existing adopted highway Sections 75 and 77 (1) once works are complete on site. The Highway Authority should also be contacted about the adoption of any new highway works, which would be dedicated via Section 72 (Highways Act 1980).
15 INFORMATIVE: At no point during the works is the adopted highway that surrounds the site to be blocked or obstructed without prior agreement of the highway authority. The applicant should contact the Council’s Streetworks Co-ordinator on 01287 612579 to make the relevant arrangements
16 INFORMATIVE: A joint condition survey should be undertaken by the applicant, their contractor and the Highway Authority of both Bath Street and Esplanade.
17 INFORMATIVE: The applicant is advised to contact the Council’s Naming and Numbering Officer, Sandra Beaty on 01287 612538 to make arrangements for the correct postal address for the development.
18 INFORMATIVE: With regard to the current on-street parking and loading bay with in the application site, the applicant should be advised that the existing Traffic Regulation Orders will require amending to reflect the new highway layout, again early contact with the Highway Authority is recommended.
19 INFORMATIVE: As the proposals will lead to some disruption of bus services during their construction, the applicant should speak to the Public Transport Section of Tess Valley Unlimited to make arrangements for temporary bus stops and ascertain whether alteration to services will be required.
20 INFORMATIVE: As the applicants proposals will impact on both bus routes and a recognised HGV route through Redcar. Information about the proposals should be made available for the Traffic Management Liaison Group. Forthcoming meetings are to be held on the 19th of October and 30th November, contact should be made via the Council’s Streetworks Co-ordinator.
21 NOTE: The following development plan policies were relevant to this decision:- Local Development Framework Policy CS5, CS18, CS20, CS24, CS26, DP2, DP3, DP6 and DP7. Redcar and Cleveland Local Plan 'Saved Policies' - SH8 and SH9.
22 REASON FOR DECISION:The proposal meets the aims of local and national planning policy as it would contribute to the enhancement of the vitality and viability of the Town centre, promoting tourism and improving the public realm. There are no highway objections to the proposed realignment of the road and the scheme will not have an adverse impact on residential development or the ecology of the area. The scheme does not raise any issues in respect of crime prevention.
