# Condition Details
(1) Prior to the completion of the development a surface water management scheme shall have been implemented in accordance with a plan that has first been submitted to and agreed in writing by the Local Planning Authority. The scheme shall thereafter be retained unless otherwise first agreed in writing with the Local Planning Authority. REASON: To ensure that surface water is adequately dealt with.
(2) Adequate protective fencing must be placed around the TPO Copper Beech at the site, to standards set within BS 5837. The fencing shall be at least 2m in height, shall be placed at or outside the drip line of the tree and shall be retained in place at the site for the whole construction period. Within the protective area, no works or storage shall take place, including the storage or movement of vehicles. REASON: In order to protect the health and well being of the TPO Copper Beech in the north east corner of the site.
(3) The parking spaces shall be brought into use before the development is occupied and shall thereafter be retained at the site in perpetuity, unless otherwise agreed in writing with the Local Planning Authority. REASON: In order to ensure adequate parking provision at the site.
(4) All vehicular areas are to be bound, (the use of permeable surfacing is recommended), surfaced and sustainably drained. The fall of the new driveway shall prevent any water discharge onto the adjacent adopted highway but shall drain within curtilage. REASON: In the interests of highways safety.
(5) Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order, 1995, (or any Order revoking or re-enacting that Order) no enlargement of the dwelling(s) the subject of this permission shall be carried out without the express consent of the Local Planning Authority. REASON: To safeguard the character and appearance of the development and residential amenity.
INFORMATIVE NOTE: The developer is reminded that it is the responsibility of anybody carrying out building work to ensure mud, debris or deleterious material is not deposited from the site onto the public highway and, if it is, it shall be cleared by that person.
INFORMATIVE NOTE: At no point should the adopted highway be blocked up with out the prior consent of the Councils Highways Maintenance section
INFORMATIVE NOTE: The developer is to contact the Council's Naming and Numbering Officer, Sandra Beaty on 01287 612538, to make arrangements for the correct postal address for the development prior to commencement of any works.
INFORMATIVE NOTE: The developer is advised that the proposed development is for a sensitive land use and the development would introduce sensitive receptors on to the site. The developer is therefore recommended to identify any potential sources of contamination and that any contamination is dealt with adequately. Further information is available from the Council’s Contaminated Land Officer who has been made aware that the development is at an advanced stage. Note that if the development is likely to give rise to ‘statutorily contaminated land’ then the developer/owner would have legal liability. This liability would include the costs of ‘remediating’ the site to a condition where contamination is effectively dealt with.
NOTE: The following development plan policies were relevant to this decision:- Local Development Framework Policy CS1, CS2, CS20, CS25, DP2, & DP3.
REASON FOR DECISION: It is considered that the proposed development will not cause significant harm to the amenities of local residents or adversely affect the character and appearance of the area. The application does not raise any issues in respect of crime prevention or highway safety. The proposal accords with the Council's adopted Development Plan and Supplementary Planning Guidance.
