# Condition Details
1 (1) The use of the premises as a hot food takeaway is contrary to the Councils Interim Policy on hot food takeaways which seeks to limit the number of hot food uses in commercial centres to 5% in the interest of maintaining the vitality and viability of these centres. The proposed development if allowed would result in this threshold been exceeded. No exceptional circumstances have been demonstrated to justify this proposal. In addition the proposed use would create a situation where two A5 uses are located in adjoining units. The proposal is also contrary to policy CS18 of the Local Development Framework (2007), which seek to maintain and enhance the character of town, district and local centres.
2 (2) The proposed development would due to its location within a town centre and where there is separate residential accommodation in close proximity to the centre create conditions that would be prejudicial to the living conditions of those nearby residential occupiers by way of the activity in and around the premises, particularly during the late evening. The proposal is therefore contrary to the aims of Redcar and Cleveland Local Development Framework Policy DP2 and ‘saved’ Redcar and Cleveland Local Plan 1999 Policy SH7.
3 NOTE: The following development plan policies were relevant to this decision:- Local Development Framework Policy CS20, DP2, DP3, CS18 and CS7.
