| 2 | (1) The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990. |
| 3 | (2) Details of the external materials to be used in the carrying out of this permission (including samples) shall be submitted to, and approved in writing by the Local Planning Authority, prior to the commencement of development and the development shall not be carried out except in accordance with the approved details. REASON: To ensure the use of satisfactory materials. |
| 4 | (3) Prior to the commencement of development full details of the design, structural calculations and method statement for the proposed development shall have been submitted to the Local Planning Authority for approval in writing. The development shall be built in accordance with those details unless otherwise first agreed in writing with the Local Planning Authority. REASON: In the interests of the integrity of the bank side. |
| 5 | (4) Full details of any external lighting required in association with the development hereby approved shall be submitted to the Local Planning Authority for approval in writing. Those details shall include type, positions and luminance. The approved details shall be implemented in their entirety unless otherwise first agreed in writing. | 6 | (5) Prior to the commencement of development details of the arrangements for construction access shall have been submitted to the Local Planning Authority for approval in writing. The approved details shall be strictly adhered to unless otherwise first agreed in writing. REASON: In the interest of highways safety. |
| 7 | (6) The working hours for all construction activities on this site are limited to between 08:00 and 18:00 Mondays to Friday and 08:00 to 13:00 Saturdays and not at all on a Sunday or Bank Holidays. REASON: In the interest of neighbour amenity. |
| 8 | (7) The building hereby approved shall be used as ancillary to the use of the property as a single family dwelling only and for no other purpose. REASON: For the avoidance of doubt. |
| 9 | (8) The development hereby approved shall be built in accordance with drawing No.s 1372/4 and ‘Retaining Wall Outline Details SK2 received on 26 September 2011; 1372/2 B received 2 July 2010 and 1372/1 and 1372/3 received on 18 May 2010. REASON: To accord with the terms of the planning permission. |
| 10 | (9) In the event that contamination is found at any time when carrying out the development hereby approved that was not previously identified it must be reported in writing immediately to the Local Planning Authority. An investigation and risk assessment must be undertaken, and where remediation is necessary a remediation scheme must be prepared which shall be submitted to the Local Planning Authority for approval in writing. The approved remediation shall be completed in its entirety. REASON: To ensure the risk of contamination is minimised. |
| 11 | REASON FOR DECISION: The proposed development due to its size, design and location would be unlikely to compromise Saltburn Conservation Area, the appearance of this site and the character of the area generally. Further, due to the relationship of the proposed development to nearby property it is considered that local residential amenity would not be prejudiced. The resulting development would be unlikely to compromise highway safety and it is considered that the site would be no more vulnerable to crime than is currently the case. It is considered therefore that the proposal would meet the aims of Policies CS20, CS25, DP1, DP2, DP3 and DP9 of the Redcar and Cleveland Local Development Framework. |
