(1) The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
(2) The development hereby permitted shall be carried out in accordance with the following approved plans: 2010/220/S [00] 01 – received 13th April, 2010. 2010/220/L [20] 01 – received 13th April, 2010. 2010/220/L [20] 02 – received 13th April, 2010. 2010/220/L [20] 03 – received 13th April, 2010. 2010/220/L [20] 04 – received 13th April, 2010. 2010/220/L [90] 01 Rev A – received 13th April, 2010. REASON: For the avoidance of doubt.
(3) Prior to the commencement of development, details shall be submitted to and agreed in writing by the Local Planning Authority, of proposals to provide contractors car parking and material storage within the site. The details approved shall be retained for use until completion of the development unless first agreed in writing with the Local Planning Authority. REASON: In the interest of highways safety.
(4) Two car parking spaces shall be provided within the site prior to the development being brought into use and thereafter retained for parking purposes. REASON: To ensure that there is adequate on-site car parking to serve the development.
Informative Note: The application site is on/close to land that has been identified as having a history of potential contamination. It is not considered that the development proposed will give rise to 'significant risk' to health or pollution of controlled waters. It is recommended, however, that the attention of the applicant be drawn to the risk of contaminants in, on or under the site.
Informative Note: Before any works in connection with the development are started, a joint condition survey with the applicant, their contractor and the Highway authority should be undertaken of St. Helen’s Close and its associated footpaths.
Informative Note: The applicant is reminded that it is the responsibility of anybody carrying out building work to ensure mud, debris or deleterious material is not deposited from the site onto the public highway and, if it is, it shall be cleared by that person.
Informative Note: All vehicular areas are to be bound; the use of permeable surfacing is recommended, surfaced and sustainably drained to the satisfaction of the local planning authority. The fall of the new driveway should not discharge any water onto the adjacent adopted highway but drain within curtilage.
REASON FOR DECISION: It is considered that the proposed development and change of use will not cause significant harm to the amenities of local residents or adversely affect the character and appearance of the area. The application does not raise any issues in respect of crime prevention or highway safety. The proposal accords with the Council’s adopted Development Plan and Supplementary Planning Guidance.
NOTE: The following development plan policies were relevant to this decision:- Local Development Framework Policy CS20, DP2, DP3.
