(1) The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
(2) Throughout the life of the development, noise generated by the wind turbine hereby approved, shall not exceed 35dB (A) L90, 10 min at wind speeds not exceeding 10m/s as measured not less than 10m from the façade of the nearest noise sensitive property. In the event that noise from the turbine exceeds this threshold the developer shall submit and agree in writing a scheme of mitigation to the local planning authority within three months of the breach being identified. The agreed mitigation scheme shall be implemented within three months of the written agreement or within a timescale agreed in writing by the local planning authority and maintained in the approved manner for the lifetime of the development. REASON: To protect the residents of nearby residential properties from disturbance as a result of potential excessive noise generated during operation of the development.
(3) The permission hereby granted shall be for a period of 15 years from the date of approval, unless a further planning application is submitted and approved. Not later than 6 months after the development hereby approved becomes operational, a scheme for the restoration of the site, including the dismantling and removal of all elements above ground level, and the removal of turbine bases to a depth of 1.0m, shall be submitted to and be approved in writing by the Local Planning Authority. The approved scheme shall be carried out and completed within 12 months from the date that the planning permission hereby granted expires. REASON: The development approved is of a form that it is appropriate only to grant planning permission for the projected lifespan of the equipment. A grant of temporary planning permission and a requirement to remove the equipment and reinstate the land to its former condition is necessary to ensure that obsolete equipment is removed, unless an application for re-powering has been submitted and approved, in the interests of local amenity and landscape impacts.
(4) If the wind turbine hereby permitted ceases to operate for a continuous period of 6 months then, unless otherwise agreed in writing by the local planning authority, a scheme for the decommissioning and removal of the wind turbine and any other ancillary equipment and structures relating solely to that turbine, shall be submitted to and agreed in writing by the planning authority within 3 months of the end of the cessation period. The scheme shall include details for the restoration of the site. The scheme shall be implemented within 6 months of the date of its agreement by the local planning authority.
REASON FOR DECISION: It is considered that the proposed development will not cause significant harm to the amenities of local residents or adversely affect the character and appearance of the area. The application does not raise any issues in respect of crime prevention or highway safety. The proposal accords with the Council's adopted Development Plan and Supplementary Planning Guidance.
NOTE: The following development plan policies were relevant to this decision:- Local Development Framework Policy CS1, CS20, DP1, DP2 & DP3.
