Conditions table
# Condition Details
(1) The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
(2) The development hereby permitted shall be carried out in accordance with the following approved plans: Proposed 4 of 6 received 8 February 2010 Proposed 5 of 6 received 2 February 2010 Proposed 6 of 6 received 30 March 2010 REASON: For the avoidance of doubt.
(3) The external elevations of the extension(s) hereby approved shall be built in materials to match in type, style and colour the external elevations of the existing dwelling/building. REASON: To ensure a satisfactory form of development.
(4) The gates serving the two entrances of the drive of the dwelling shall not open out into the highway at any time. REASON: In the interests of public and highway safety.
INFORMATIVE NOTE: The applicant is reminded that the Highway Authority will not allow commencement on site without either a Section 219/220 Notice (5) or a Section 38 Agreement (Highways Act 1980) being in place.
INFORMATIVE NOTE: The applicant is reminded that it is the responsibility of anybody carrying out building work to ensure mud, debris or deleterious material is not deposited from the site onto the public highway and, if it is, it shall be cleared by that person.
INFORMATIVE NOTE: All vehicular areas are to be bound; the use of permeable surfacing is recommended, surfaced and sustainably drained to the satisfaction of the Local Planning Authority. The fall of the new driveway should not discharge any water onto the adjacent adopted highway but drain within curtilage.
INFORMATIVE NOTE: The applicant should contact Highway Maintenance section on 01287 61 2590 to discuss the provision of a permanent vehicular crossing.
INFORMATIVE NOTE: The applicant wants to purchase land from the Council and to utilise it as part of his front garden and second entrance. The area of land in question is adopted highway and as such will need to be stopped up via the magistrate's court. However without further investigation it is not possible to say whether this land would revert to the Council or the original developer of Fairfield Avenue. All costs in connection with the stopping up will have to be met by the applicant.
NOTE: The following development plan policies were relevant to this decision:- Local Development Framework Policy CS20, DP2 and DP3.
REASON FOR DECISION: It is considered that the proposed development will not cause significant harm to the amenities of local residents or adversely affect the character and appearance of the area. The application does not raise any issues in respect of crime prevention or highway safety. The proposal accords with the Council's adopted Development Plan and Supplementary Planning Guidance.
