# Condition Details
1 (1) The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
2 INFORMATIVE NOTE: The applicant is advised that the Highway Authority will not allow commencement of development on site without either a Section 29/220 Notice (1) or a Section 38 Agreement (Highways Act 1980) being in place. For further information the applicant should contact Darren Edmends on 01287 612537.
3 (2) The development hereby permitted shall be carried out in accordance with the following approved plans: Drawing No: SK001 Revision B Drawing No: SK003 Revision / Drawing No: SK004 Revision B Drawing No: SK005 Revision B REASON: For the avoidance of doubt.
4 (3) Details of the external materials to be used in the carrying out of this permission (including samples) shall be submitted to, and approved in writing by the Local Planning Authority, prior to the commencement of development and the development shall not be carried out except in accordance with the approved details. REASON: To ensure the use of satisfactory materials.
5 (4) A landscaping scheme shall be submitted to, and approved in writing by, the Local Planning Authority prior to the commencement of development. The details shall include size, type and species of plant and indicate the proposed layout and surfacing of all open areas. A programme of work should also be submitted and implemented in accordance with the approved details. REASON: To reserve the rights of the Local Planning Authority with regard to these matters.
6 (5) All planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting and seeding season following the occupation of the buildings or the completion of the development, whichever is sooner, and any trees or plants which within a period of ten years from the completion of the development die, are removed, or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species unless the Local Planning Authority gives written consent to any variation. REASON: To ensure the satisfactory implementation of the approved scheme in the interests of the visual amenities of the locality.
7 (6) Prior to the first occupation of the development boundary walls and fences shall have been erected in accordance with a scheme that has first been agreed in writing with the Local Planning Authority and shall thereafter be maintained. REASON: In the interests of visual and residential amenity.
8 (7) A minimum of two car parking spaces shall be provided within the curtilage of the dwelling prior to first occupation and thereafter retained for parking purposes. Details of the surface treatments to be used shall be submitted to and agreed in writing with the Local Planning Authority prior to construction of the parking spaces. REASON: To ensure that there is adequate on-site car parking to serve the development.
9 (8) Prior to the commencement of development details of the engineering proposals showing the specification and design of the access road shall be submitted to, and approved in writing by, the Local Planning Authority. The approved scheme shall be implemented and available for use prior to the occupation of the dwelling hereby approved. REASON: In the interest of highway safety.
10 (9) No development shall take place unless in accordance with the mitigation detailed within the protected species report ‘Bat Survey at Former Nessfield Residential Care Home Morton Carr Lane Nunthorpe Middlesborough,’ including, but not restricted to adherence to timing and spatial restrictions; provision of mitigation in advance; adherence to precautionary working methods and bat access to new buildings. REASON: In the interests of biodiversity.
11 (10) Prior to the commencement of development on site all contractors must be given the method statement contained within the protected species report. REASON: In the interests of biodiversity.
12 (11) No trees on or overhanging the site shall be lopped, topped, pruned or felled without the prior written consent of the Local Planning Authority. REASON: In the interests of the visual amenities of the locality.
13 (12) Prior to the commencement of the development, details of the methods to be used to protect the existing trees on the site from construction work shall be submitted to and approved in writing by the Local Planning Authority, and such measures as approved shall be carried out before the development commences and maintained throughout the period of construction until the completion of the development. REASON: To ensure that existing trees/hedges on and adjacent to the site which are to be retained, are protected from vehicles and works involved in the construction of the development.
14 (13) Prior to the commencement of development full details of the proposed drainage arrangements shall be submitted to the Local Planning Authority for approval in writing. The scheme should demonstrate sustainable principles. The approved details shall be implemented in their entirety prior to the first occupation of any of the dwellings hereby approved. REASON: To ensure satisfactory drainage at this site.
15 (14) The working hours for all construction activities on this site are limited to between 08:00 and 18:00 Mondays to Friday and 08:00 to 13:00 Saturdays and not at all on a Sunday or Bank Holidays. Any deliveries and collections during the period of construction shall be between these hours. REASON: In the interest of neighbour amenity.
16 (15) All temporary and permanent lighting provided to the proposed development shall be shielded to prevent light spillage beyond the boundary of the development. REASON: In the interest of residential amenity.
17 (16) Unless otherwise agreed by the Local Planning Authority in writing, development other than that required to be carried out as part of an approved scheme of remediation must not commence until parts (b) to (e) have been complied with. If unexpected contamination is found after development has begun, development must be halted on that part of the site affected by the unexpected contamination to the extent specified by the Local Planning Authority in writing until condition (e) has been complied with in relation to that contamination. (b) Submission of Remediation Scheme A detailed remediation scheme to bring the site to a condition suitable for the intended use by removing unacceptable risks to human health, buildings and other property and the natural and historical environment must be prepared, and is subject to the approval in writing of the Local Planning Authority. The scheme must include all works to be undertaken, proposed remediation objectives and remediation criteria, timetable of works and site management procedures. The scheme must ensure that the site will not qualify as contaminated land under Part 2A of the Environmental Protection Act 1990 in relation to the intended use of the land after remediation. (c) Implementation of Approved Remediation Scheme The approved remediation scheme must be carried out in accordance with its terms prior to the commencement of development other than that required to carry out remediation, unless otherwise agreed in writing by the Local Planning Authority. The Local Planning Authority must be given two weeks written notification of commencement of the remediation scheme works. Following completion of measures identified in the approved remediation scheme, a verification report (referred to in PPS23 as a validation report) that demonstrates the effectiveness of the remediation carried out must be produced, and is subject to the approval in writing of the Local Planning Authority. (d) Reporting of Unexpected Contamination In the event that contamination is found at any time when carrying out the approved development that was not previously identified it must be reported in writing immediately to the Local Planning Authority. An investigation and risk assessment must be undertaken in accordance with the requirements of part (a) and where remediation is necessary a remediation scheme must be prepared in accordance with the requirements of part (b), which is subject to the approval in writing of the Local Planning Authority. Following completion of measures identified in the approved remediation scheme a verification report must be prepared, which is subject to the approval in writing of the Local Planning Authority. (e) Long Term Monitoring and Maintenance A monitoring and maintenance scheme to include monitoring the long-term effectiveness of the proposed remediation over a period of 5 years, and the provision of reports on the same must be prepared, both of which are subject to the approval in writing of the Local Planning Authority. Following completion of the measures identified in that scheme and when the remediation objectives have been achieved, reports that demonstrate the effectiveness of the monitoring and maintenance carried out must be produced, and submitted to the Local Planning Authority. This must be conducted in accordance with DEFRA and the Environment Agency’s ‘Model Procedures for the Management of Land Contamination, CLR 11’ REASON : To ensure that risks from land contamination to the future users of the land and neighbouring land are minimised, together with those to controlled waters, property and ecological systems, and to ensure that the development can be carried out safely without unacceptable risks to workers, neighbours and other offsite receptors.
18 INFORMATIVE NOTE: The applicant is reminded that it is the responsibility of anybody carrying out building work to ensure mud, debris or deleterious material is not deposited from the site onto the public highway and, if it is, it shall be cleared by that person.
19 INFORMATIVE NOTE: At no point should the adopted highway be blocked up with out the prior consent of the Councils Highways Maintenance section.
20 REASON FOR DECISION: The site is within the limits to development as set out in the Council’s Development Plan. The layout and design are acceptable and accords with planning policy. The development respects the amenity and character of the area. The application does not raise any issues in respect of crime prevention or highway safety. The proposal therefore accords with the Council’s adopted Development Plan.
