|---|---|
(1) The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
INFORMATIVE: The applicant should be advised that any noise emanating from the premises should not contribute more than 3 dB(A) to existing background noise levels, when measured at a distance of 1 metre from the façade of any adjacent dwelling, and when calculated as an Leq(A) of 10 minutes.
(2) Details of a ventilation and fume extraction system suitable for all hot food take away uses within Class A5, including a full technical specification by a suitably qualified technical professional person, specifying the position of ventilation fume or flue outlet points and the type of filtration or other fume treatment to be installed and used at the premises in pursuance of this permission shall be submitted before the development hereby approved commences. The approved scheme shall thereafter be retained in full accordance with the approved details. The system shall be operated and maintained in accordance with the manufacturers recommendations including the frequency of replacement filters. REASON: In the interests of amenity.
(3) Before any ventilation equipment, fixed plant and machinery, is used on the premises it shall be enclosed with sound insulating material and mounted in a way that will minimise transmission of structure borne sound in accordance with a scheme to be approved in writing by the Local Planning Authority. REASON: In the interests of amenity.
(4) The premises shall only operate for the use hereby permitted between the hours of 07:00hrs and 23:00hrs daily. REASON: In the interests of amenity.
INFORMATIVE: The ventilation and extract system referred to in condition 2 should incorporate some form of filtration system (usually activated carbon filtration) and shall be operated and maintained in accordance with the manufacturers recommendations including the frequency of replacement filters.
INFORMATIVE: Any external ducting shall be fitted by an experienced engineer and should discharge at least 1 metre above eaves level and above any windows. Low level discharge should be avoided.
INFORMATIVE: The applicant is reminded that the ancillary hot food takeaway use should remain ancillary to the main use of the premisees as a café. Should the takeaway use increase in magnitude at the site this may require planning permission, which may not be granted.
INFORMATIVE: The applicant is advised to contact the Health and Safety Section of the Council in respect of the minimum standards for the provision of sanitary facilities at the site. Please refer to British Standard BS 6465-1:2006 and contact David Kettlewell on 01287 612416.
NOTE: The following development plan policies were relevant to this decision:- Local Development Framework Policy CS1, CS2, CS18, CS20, CS25, DP2 and DP3.
REASON FOR DECISION: The proposed change of use is considered to be acceptable in this location by virtue of the fact that it would not have an adverse affect on the character or amenity of the area. The proposal does not raise any issues in respect of highway safety or crime prevention. The proposal therefore accords with the Council's adopted Development Plan.
