# Condition Details
REASON FOR DECISION: 1. The proposed hot food takeaway use, by virtue of the activities associated with it, would be likely to cause unacceptable levels of nuisance and disturbance to nearby residential occupiers to the detriment of the amenities they may reasonably expect to enjoy. The proposal would therefore be contrary to policy SH7 of the Redcar and Cleveland Local Plan and policies DP3 and CS18 of the Local Development Framework 2007.
REASON FOR DECISION: 2. The applicant has failed to provide sufficient information regarding the proposed ventilation and fume extraction system to determine whether the fumes could be adequately discharged from the premises to protect residential amenity, without harming the character and appearance of the host building and Skelton Conservation Area, contrary to policies SH7 of the Redcar and Cleveland Local Plan and policies DP3 and DP9 of the Local Development Framework 2007
REASON FOR DECISION: 3. The proposed development would due to its location within the local centre where other similar uses exist, result in an undue concentration of such uses exceeding the limit of 5% advised by the ‘Interim Policy on Hot Food Takeaways’. No exceptional circumstances have been demonstrated to justify this proposal and it is therefore considered that the proposal would be likely to prejudice the viability of this local centre contrary to the aims of the Redcar and Cleveland Local Development Framework policy CS18 and ‘Interim Policy on Hot Food Takeaways’.
NOTE: The following development plan policies were relevant to this decision:- Local Development Framework Policy CS1, CS2, CS18, CS20, CS25, DP2, DP3 and DP9 and Policy SH7 of the Redcar and Cleveland Local Plan.
