# Condition Details
(1) The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
(2) The materials to be used in the construction of the rebuilt sections of barn, hereby approved, shall match the materials of the existing site in their size, material, finish and mortar joints, and all other materials to be used in the development shall be in accordance with those specified under section 1.8 of the submitted Design and Access Statement and the approved plans (both received 11/08/2009), unless otherwise agreed in writing by the Local Planning Authority. REASON: In the interests of residential amenity.
(3) The development hereby approved shall be built in accordance with the amended Site Layout and Location Plans (received 20/10/2009) unless first agreed in writing with the Local Planning Authority. REASON: For the avoidance of doubt.
(4) The development shall not commence until visibility splays, providing clear visibility of 2.4 by 43 metres, measured down the centre of the access road and the nearside channel line of the major road, have been provided at the junction of the access road with the High Street. The visibility splays shall be constructed before general development of the site commences so that construction traffic is safeguarded and shall thereafter be maintained in perpetuity, to the satisfaction of the Local planning Authority. REASON: In the interests of highway safety.
(5) All vehicular areas are to be bound, (the use of permeable surfacing is recommended), surfaced and sustainably drained to the satisfaction of the local planning authority, and the fall of the new access shall not discharge any water onto the adjacent adopted highway but drain within curtilage. REASON: In the interests of highway safety.
(6) The parking spaces shown on the approved plans shall be brought into use before the development is completed and shall thereafter be retained at the site in perpetuity. REASON: In the interests of highway safety.
(7) Before the development commences details shall be submitted and approved in writing of proposals to prevent mud/debris from being deposited on the highway for the duration of the construction period. REASON: In the interests of highway safety.
(8) The units hereby approved shall only be used as holiday accommodation, for periods of not more than 3 months in any single letting, tenancy or occupancy, and shall not be used as residential dwelling houses within Class C3 of the Town and Country Planning (Use Classes) Order. REASON: The site is outside the development limits where new residential development would be inappropriate, in order to comply with policy DP2 of the adopted development plan.
1. You are advised that this planning permission has been granted on the basis that the works required to upgrade the existing buildings at the site are satisfactory, and do involve the substantial rebuilding of the existing buildings, other than that specified in the submitted structural report and application details. If further works are required to the walls of the existing buildings, over and above those already specified (9) this may materially alter the nature of the development and thereby require planning permission. Any works would then be likely to be unauthorised.
2.The applicant should contact the Council’s Naming & Numbering Officer, Sandra Beaty on 01287 612538, to make arrangements for the correct postal address for the development prior to commencement of any works.
REASON FOR DECISION: The conversion of the site to holiday lets would not involve the fundamental reconstruction of the fabric of the existing farm buildings and would not cause any adverse impacts. The application does not raise any issues in respect of crime prevention or highway safety. The proposal accords with the development plan and supplementary planning guidance.
NOTE: The following development plan policies were relevant to this decision:- Local Development Framework Policy CS1, CS2, CS6, CS12, CS20, CS22, CS23, CS25, DP2, DP3 and DP14.
