# Condition Details
(1) The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
(2) The permission hereby approved shall be for a temporary period only, expiring on 31/08/2016, after which time the use shall be ceased and all structures removed from the site completely. REASON: In the interests of amenity.
(3) No development shall take place until there has been submitted to, and agreed in writing by the Local Planning Authority, a scheme of landscaping which shall include indications of all existing trees and hedgerows on the land (if any), and details of any to be retained, together with measures for their protection in the course of the development. REASON: To reserve the rights of the Local Planning Authority with regard to these matters
(4) All pedestrian and vehicular surfaces within the site are to be sealed, surfaced and drained to the satisfaction of the Local Planning Authority. REASON: In the interests of highway safety and the amenity of the site.
(5) Before the development commences details shall be submitted and approved in writing of proposals to provide contractor car parking and compound within the site boundary for the duration of the works on site. REASON: In the interests of highway safety.
(6) Before the development commences, details of a scheme to prevent mud/debris from being deposited on the highway for the duration of the construction period shall be submitted to and approved in writing by the Local Planning Authority. REASON: In the interests of highway safety
(7) The development hereby permitted shall not be commenced until such time as a scheme to prevent contamination of groundwater has been submitted to and approved in writing by the Local Planning Authority. Any such scheme shall be supported by detailed information regarding the type of drilling fluid, cement grout and casing materials to be used. The scheme shall be fully implemented during borehole drilling and construction, in accordance with the scheme, or any changes as may subsequently be agreed, in writing, by the Local Planning Authority. REASON: The proposal to drill additional boreholes will result in a risk to the underlying principle aquifers. The information provided shows that this risk will be minimised by the use of cemented steel casing where appropriate. Further details are required regarding the type of cement with the preferred option being the use of a bentonite seal. The proposal makes reference to the use of oil-based drilling mud. The risk to groundwater of using oil-based drilling mud with principle aquifers needs to be assessed. A water-based drilling fluid would reduce this risk.
(8) Any facilities for the storage of oils, fuels or chemicals shall be sited on impervious bases and surrounded by impervious bund walls. The volume of the bunded compound shall be at least equivalent to the capacity of the tank plus 10%. If there is multiple tankage, the compound should be at least equivalent to the capacity of the largest tank, or the combined capacity of interconnected tanks, plus 10%. All filling points, vents, gauges and sight glasses must be located within the bund. The drainage system of the bund shall be sealed with no discharge to any watercourse, land or underground strata. Associated pipework should be located above ground and be protected from accidental damage. All filling points and tank overflow pipe outlets should be detailed to discharge downwards into the bund. REASON: To prevent pollution of the water environment.
(9) Development shall not commence until a detailed scheme for the diversion of its apparatus or redesign of the proposal to avoid building over by the development hereby approved has been submitted to and approved in writing by the Local Planning Authority in consultation with Northumbrian Water. Thereafter the development shall take place in accordance with the approved details. REASON: Trunk water mains cross the site and are shown built over on the application. Northumbrian Water Ltd will not permit a building over or close to its apparatus. Diversion or relocation of the apparatus may be possible at the applicant’s full cost.
(10) Construction works at the site shall be limited to 07:00 to 18:00 hours Monday to Friday and 07:00 to 13:00 Saturday, with no working on a Sunday or Public Holidays, unless otherwise agreed in writing by the Local Planning Authority. REASON: In the interests of amenity.
(11) Any installation of plant, machinery, or extract ventilation (including any fans), should be checked for potential levels of noise emanating from the premises before the development commences. Any noise emitted from the new units should not contribute any more than 3 dB(A) to existing background noise levels, when measured at a distance of 1 metre from the façade of any adjacent noise sensitive premises, and when calculated as a n Leq(A) of 10 minutes. REASON: In order to ensure satisfactory noise levels in the interests of residential amenity and the market vitality of the Kirkleatham Business Park.
(12) The proposed drilling rig shall be located at the site for no more than 10 weeks and only during the initial borehole drilling period, after which time the rig and associated structures shall be permanently removed from the site, unless otherwise approved in writing by the Local Planning Authority. REASON: In the interests of visual amenity.
(13) Flaring at the site shall only take place during the test programme period (as defined within the planning application details as submitted) and shall only take place during the day-time (ie. between 07:00-19:00 hrs). REASON: In order to protect the amenity of residential neighbours.
(14) At the end of production at the site, all above-ground buildings, the perimeter fence, access road and hardcore over the site shall be removed and the land re-graded as agricultural land, in accordance with the details contained within the Supporting Statement accompanying the planning application hereby approved. REASON: In the interests of the visual amenity and ecology of the site.
INFORMATIVE NOTE: Regarding Northumbrian Water, it is recommended that the applicant should contact Trevor Bell (0845 7171100) to discuss issues around crossing NWL’s twin 1067mm steel water mains and any potential issues regarding cathodic protection on the water mains.
INFORMATIVE NOTE: Whilst the previous field survey was done at a time which was not the most appropriate for a conclusive water vole survey, the Environment Agency recommend that the ditch on site be checked again prior to commencement of construction to confirm the absence of water vole. A survey and risk assessment should: Identify the impacts of the scheme on water voles; and Propose mitigation for any adverse ecological impacts or compensation for loss. Any proposals to culvert, divert, fill or obstruct the flow in these watercourses will require the prior written consent of the Environment Agency under the Land Drainage Act 1991. The surface water drainage regime for the site is being directed to an attenuation pond before discharge into drainage ditches. There are no concerns over this, however, this is base don the premise that there will be no increase in surface water discharge above existing rates. Should this not be the case, the Environment Agency would wish to be reconsulted.
REASON FOR DECISION: The site is within an area identified for industrial/warehousing purposes. The design and siting of the development takes account of the principles set out in the Council’s supplementary planning guidance. The proposal therefore accords with the Council’s adopted Development Plan.
NOTE: The following development plan policies were relevant to this decision:- Local Development Framework Policy CS1, CS2, CS5, CS20, DP2 and DP3 and Supplementary Planning Guidance Appendix 10 of the Redcar and Cleveland Local Plan.
