No exceptional circumstances have been demonstrated to justify this proposal. The proposal is also contrary to policy CS18 of the Local Development Framework (2007), which seeks to maintain and enhance the character of town, district and local centres. |
| 2 | NOTE: The following development plan policies were relevant to this decision:- Local Development Framework Policy CS6, CS18, CS20, CS25, DP2, DP3, DP9, DP10 and Interim Policy on Hot Food Takeaways and Saved Policy SH7 of the Redcar and Cleveland Local Plan. |
| 3 | (2) The proposed development would due to its location within a town centre and where there is separate residential accommodation in close proximity to the premises create conditions that would be prejudicial to the living conditions of those nearby residential occupiers by virtue of the activity in and around the premises, particularly during the late evening. The proposal is therefore contrary to the aims of Redcar and Cleveland Local Development Framework Policy DP2 and ‘saved’ Redcar and Cleveland Local Plan 1999 Policy SH7. |
