| 1 | (1) The proposed development would due to its location within a local centre and where there is separate residential accommodation at first floor and in close proximity to the centre create conditions that would be prejudicial to the living conditions of those nearby residential occupiers by way of the activity in and around the premises, particularly during the late evening. The proposal is therefore contrary to the aims of Redcar and Cleveland Local Development Framework Policy DP2 and ‘saved’ Redcar and Cleveland Local Plan 1999 Policy SH7. |
| 2 | (2) Full details of the extraction flue have not been submitted. It is considered that due to its design, size and position it would be detrimental to both the appearance of the area and be likely to be detrimental to the living conditions of the occupiers of the first floor accommodation due to potential smells and vibration. The proposal is therefore contrary to the aims of Local Development Framework Policies CS20, DP2 and DP3 and Redcar and Cleveland Local Plan 1999’saved’ Policy SH7. |
| 3 | (3) The proposed development would due to its location within a local centre where other similar uses exist would result in an undue concentration of such uses exceeding the limit of 5% advised by the ‘Interim Policy on Hot Food Takeaways’ and being adjacent to premises currently operating as a hot food takeaway. No exceptional circumstances have been demonstrated to justify this proposal. It is considered therefore that the proposal would be likely to prejudice the viability and vitality of this local centre contrary to the aims of Redcar and Cleveland Local Development Framework Policy CS18 and ‘Interim Policy on Hot Food Takeaways’. |
