(1) The premises shall not be open for customers outside the following hours; Monday - Saturday 0730 - 1430 and not at all on Sunday REASON: In the interests of the amenities of nearby residents.
(2) A minimum of two car parking spaces shall be provided within the curtilage of the site at all times. REASON: To ensure that there is adequate on-site car parking provision to serve the premises.
(3) The premises shall not be used wholly as a hot food takeaway within Class A5 of the Schedule to the Town And Country Planning (Use Classes) Order 1987, or an equivalent provision to the Class in any Statutory Instrument revoking or re-enacting that Order unless the prior consent of the local planning authority has been obtained. REASON: In the interests of local amenity.
INFORMATIVE: The applicant is advised that permission is granted on the basis that the premises will be operated with minimum hot food preparation and, therefore, there is no requirement to install a commercial extraction system. However, should the operation alter at any time in the future or if odour complaints are received then the applicant should be aware that the action may be taken under statutory nuisance provisions with a view to odour abatement being required on the premises.
(4) Any installations of plant, machinery, or extract ventilation (including any fans), should be checked for potential levels of noise emanating from the premises. Any noise emitted from the new units should not contribute any more than 3dB(A) to existing background noise levels, when measures at a distance of 1 metre from the façade of any adjacent dwelling, and when calculated as an Leq(A) of 10 minutes. REASON: In the interests of the amenities of the area.
INFORMATIVE: The applicant will be required to contact the Highway maintenance section on 01287 612590 with regard to extending the vehicular crossing to serve the on-site car parking spaces.
REASON FOR DECISION: The proposed change of use is considered to be acceptable in this location by virtue of the fact that it would not have an adverse affect on the character or amenity of the area. The proposal does not raise any issues in respect of highway safety or crime prevention. The proposal therefore accords with the Council's adopted Development Plan.
NOTE: The following development plan policies were relevant to this decision:- Local Development Framework Policy CS20, DP2 and DP3 and Supplementary Planning Guidance Appendix 3 of the Redcar and Cleveland Local Plan.
