# Condition Details
1 (1) The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
2 (2) A scheme for the prevention of mud/debris being deposited on the highway during the construction phase shall be submitted to the Local Planning Authority prior to the commencement of works. The approved scheme shall be adhered to for the duration of the construction phase. REASON: In the interests of highway safety.
3 (3) A phasing and traffic management plan for the construction phase shall be submitted to the Local Planning Authority for approval in writing prior to the commencement of works. The details should include working hours, maintenance of access for the lifeboat and for local fishermen site accesses and delivery routes. The approved scheme shall be adhered to for the duration of the construction phase. REASON: In the interests of highway safety, public safety and the local economy.
4 (4) At no time during the construction works is the adopted highway adjacent to the site to be blocked or obstructed without the prior agreement of the Highway Authority. REASON: In the interests of highway safety.
5 (5) Details of materials to be used for all hard surfaces shall be submitted to, and approved in writing by the Local Planning Authority, prior to the commencement of the development and the development shall not be carried out except in accordance with the approved details. REASON: To ensure the use of satisfactory materials.
6 (6) The compound hereby permitted shall be removed/discontinued and the land restored to its former condition on completion of construction works in accordance with a scheme of work submitted to and approved by the Local Planning Authority unless the prior consent of the Local Planning Authority has been obtained for an extension to the period of validity. REASON: The development is such that it would not be approved on a permanent basis in this location.
7 (7) Prior to their installation full details of the proposed interpretative boards shall have been submitted to the Local Planning Authority for approval in writing. The approved interpretative boards shall be installed concurrently with each phase of the development and thereafter be maintained. REASON: In the interests of nature conservation.
8 (8) Full details of landscaping, street furniture, public art, railings, other ancillary structures together with any reinstated/relocated existing structures shall be submitted to the Local Planning Authority for approval in writing prior to the commencement of the works to install/construct those features. The approved details shall be implemented in their entirety and thereafter be maintained unless otherwise first agreed in writing with the Local Planning Authority. REASON: In the interests of visual amenity.
9 (9) The mitigation outlined within the ‘Environment Agency Redcar Flood Alleviation Scheme Environmental Statement Final October 2008’ shall be adhered to unless otherwise first agreed in writing with the Local Planning Authority. REASON: For the avoidance of doubt.
10 (10) The development hereby approved shall be built in accordance with the amended plans - drawing No.s B0220800/PL/002 Rev 0, B0220800/PL/010 Sheets 1-5, 5A, 6-9; received by the Local Planning Authority on 20 January 2009 unless first agreed in writing with the Local Planning Authority. REASON: For the avoidance of doubt.
11 INFORMATIVE NOTE: A joint highway condition survey with the developer, their contractor and the Highway Authority is advised prior to the commencement of works.
12 NOTE: The following development plan policies were relevant to this decision:- Local Development Framework Policies CS2, CS5, CS20, CS24, DP2, DP3, DP4, DP7, DP10 and DP11.
13 REASON FOR DECISION: It is considered that the proposed development is the optimum scheme for flood protection whilst reducing the adverse impacts to the minimum. Once implemented the benefits of the scheme that in addition to the flood protection will deliver environmental improvements to the seafront without creating material harm to residential amenity or highway safety. It is the case that the imperative reasons for the scheme override the loss of habitat. The proposed mitigation by habitat creation has been agreed with Natural England. This area would be no more vulnerable to crime than is presently the case. This scheme therefore complies with both local and national planning policy.
