# Condition Details
1 The proposed use of the premises as a hot food takeaway would be detrimental to the amenities of nearby residents by virtue of increased noise and other nuisances. The application is therefore contrary to policy DP2 of the Redcar and Cleveland Local Development Framework (2007) and saved policy SH7 of the Redcar and Cleveland Local Plan (1999).
2 NOTE: The following development plan policies were relevant to this decision:- Local Development Framework Policies CS18, CS20, DP2 and DP3, Interim Policy on Hot Food Takeaways (2008) and SH7 of the Redcar and Cleveland Local Plan.
3 () The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
4 () The use hereby permitted shall not begin until a scheme for the extractin and treatment of effluvia from the cooking equipment, including details of noise levels emitted form the flues, has been submitted to and approved in qwriting by the Local Planning Authority and implemented in accordance with the approved details.
5 () The use hereby permitted shall not be open to customers outside of the hours of 08:00 - 21:00 on any day.
