# Condition Details
1 (1) The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
2 (2) These elevations for the onshore substations relate only to the amended plan received by the Local Planning Authority on 21/10/08. REASON: For the avoidance of doubt.
3 (3) The installation of any plant, machinery, or extract ventilation (including any fans), should be checked for potential levels of noise emanating from the units. Any noise emitted from the new units should not contribute any more than 3 dB(A) to existing background noise levels, when measured at a distance of 1 metre from the façade of any adjacent dwelling, and when calculated as an Leq(A) of 10 minutes. REASON: In the interests of the amenities of the locality
4 (4) No development shall proceed unless in accordance with the conclusions and recommendations of the approved flood risk assessment (ref 13532rr696 dated November 2007). REASON: To reduce the risk from flooding.
5 (5) Prior to commencement of development approved by this planning permission, the following components of a scheme to deal with the risks associated with contamination of the site shall each be submitted to and approved, in writing, by the local planning authority: 1. A preliminary risk assessment which has identified: - all previous uses - potential contaminates associated with those uses - a conceptual model of the site indicating sources, pathways and receptors - potentially unacceptable risks arising from contamination at the site 2. A site investigation scheme, based on (1) to provide information for a detailed assessment of the risk to all receptors that may be affected, including those off site. 3. The site investigation results and detailed risk assessment (2) and, based on these, an options appraisal and remediation strategy giving full details of the remediation measures required and how they are undertaken. 4. A verification plan providing details of the data that will be collected in order to demonstrate that the works set out in (3) are complete and identifying any requirements for longer-term monitoring of pollutant linkages, maintenance and arrangements for contingency action. Any changes to these components require the express consent of the local planning authority. The scheme shall be implemented as approved. REASON: To protect water quality in the South Gare and Coatham Sands SSSI.
6 (6) If during development, contamination not previously identified is found to be present at the site then no further development (unless otherwise agreed in writing with the Local Planning Authority) shall be carried out until the developer has submitted, and obtained written approval from the Local Planning Authority for, an amendment to the remediation strategy detailing how this unsuspected contamination shall be dealt with. REASON: To protect water quality in the South Gare and Coatham Sands SSSI.
7 (7) No development shall take place within the area indicated until the applicant, or their agents or successors in title, has completed the implementation of a phased programme of archaeological work in accordance with a written scheme of investigation submitted by the applicant and approved in writing by the Local Planning Authority. REASON: The site is of archaeological interest.
8 (8) Prior to the commencement of development details shall be submitted to, and approved by, the Local Planning Authority in writing to prevent mud/debris from being deposited on the highway for the duration of the construction period. REASON: In the interest of highway safety.
9 (9) All cabling work should be carried out in accordance with the information with the Environmental Statement Addendum May 2008 and the mitigation measures set out in Section 6.7.11 of that document shall be implemented unless previously agreed in writing with the Local Planning Authority. REASON: To ensure a satisfactory form of development.
10 (11) Reinstatement of the route of the temporary access across the beach and associated compound area shall be carried out to the satisfaction of the Local Planning Authority. REASON: To safeguard the character of the protected areas.
11 INFORMATIVE: The applicant should be aware of the recommendations contained within the letter dated 5th August 2008 from the Environment Agency and should consider these during the construction phase of development.
12 (10) Details of materials to be used on the external elevations of the development shall be submitted to and agreed in writing by the Local Planning Authority prior to the development being commenced. REASON: To ensure the use of satisfactory materials.
13 NOTE: The following development plan policies were relevant to this decision:- Local Development Framework Policies CS1, CS2, CS20, CS21, CS22, CS24, DP1, DP2 and DP3.
14 REASON FOR DECISION: The site of the sub-station is located in an established industrial area and the development is considered to be acceptable in this location. The cable link to the offshore development is to be underground and therefore will not have any visual impact on the area. Where the cable crosses the SSSI/SPA directional drilling will be employed to minimise any impact on the protected areas. Accordingly it is not considered that the development will have an adverse effect on the integrity of the designated sites. Subject to suitable safeguarding conditions, it is not considered that the development will have an adverse impact on the amenities of residents and occupiers of nearby properties.
