# Condition Details
1 (1) The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
2 (2) Details of materials to be used on the external elevations of the development shall be submitted to and agreed in writing by the Local Planning Authority prior to the development being commenced. REASON: To ensure the use of satisfactory materials.
3 (3) No development approved by this permission shall be commenced until:- (a) The application site has been subjected to a detailed scheme for the investigation and recording of contamination including soil contamination, ground/surface water contamination, landfill gas, leachates and stability as appropriate; (b) Detailed proposals for the removal, containment or otherwise rendering harmless any contamination (the 'Reclamation Method Statement') have been determined through risk assessment and approved in writing by the Local Planning Authority; (c) The works specified in the Reclamation Method Statement have been completed in accordance with the approved scheme; Any contamination not considered in the Reclamation Method Statement but identified during the reclamation works should be subject to further risk assessment and remediation proposals agreed with the Local Planning Authority. A report demonstrating that the works were carried out in accordance with the approved scheme (the 'Validation Report') should be submitted to the Local Planning Authority within 2 months of completion of the development. REASON: The site may be contaminated as a result of past or current uses and/or is within 250 metres of a site which has been landfilled and the Local Planning Authority wishes to ensure that the proposed development can be implemented and occupied with adequate regard to environmental and public protection.
4 (4) Details of a ventilation and fume extraction system suitable for all hot food uses within class A3, including a full technical specification by a suitably qualified technical professional person, specifying the position of ventilation fume or flue outlet points and the type of filtration or other fume treatment to be installed and used at the premises in pursuance of this permission shall be submitted to and approved in writing by the Local Planning Authority and shall be installed before the development hereby permitted commences and thereafter shall be retained in full accordance with the approved details. REASON: In the interest of the amenities of the area.
5 (5) Prior to any ventilation or fume extraction system being used on the premises it shall be enclosed with sound insulating material and mounted in a way that will minimise transmission of structure borne sound in accordance with a scheme to be submitted to and approved in writing with the Local Planning Authority. REASON: In the interest of the amenities of the area.
6 (6) Prior to any fixed plant or machinery, including refrigeration or air-conditioning equipment being used on the premises it shall be enclosed with sound insulating material and mounted in a way which will minimise transmission of airborne and structure-borne sound in accordance with a scheme to be submitted to and approved in writing with the Local Planning Authority. REASON: In the interest of the amenities of the area.
7 (7) The premises shall only operate between the hours of 06.00 and 23.30 each day. REASON: In the interest of the amenities of the area.
8 (8) The ventilation and extraction system referred to Condition 1 shall incorporate a filtration system and shall be operated and maintained in accordance with the manufacturers recommendations. REASON: In the interest of the amenities of the area.
9 (9) No servicing/deliveries to the new site shall occur between the hours of 09:00 and 18:00 Monday to Saturday and 10:30 and 16:00 on a Sunday. REASON: In the interest of highway and pedestrian safety.
10 (10) Prior to the commencement of the use of the hereby approved an updated travel plan shall be submitted to and agreed in writing by the Local Planning Authority. REASON: To ensure a satisfactory form of development.
11 (11) Prior to the commencement of development details shall be submitted and approved in writing of proposals to provide contractor car parking and materials storage compound within the site boundary for the duration of the works. REASON: In the interest of highway safety.
12 (12) Prior to the commencement of development details shall be submitted to and approved in writing of proposals to prevent mud/debris from being deposited on the highway for the duration of the construction period. REASON: In the interest of highway safety.
13 (13) Prior to the commencement of development details shall be submitted to and approved in writing of a traffic management plan for the construction phase of the works. REASON: In the interest of highway safety.
14 INFORMATIVE: This permission relates solely to the proposed restaurant on the application site. The applicant is advised that the installation of new signage on the proposed building will require advertisement consent from the Local Planning Authority.
15 REASON FOR DECISION: The proposed development is considered to be appropriate within this existing commercial centre. It would not have an adverse impact on the character and amenity of the area. The application does not raise any issues in respect of crime prevention or adversely affect highway safety. The proposal accords with the Council's Adopted Development Plan.
16 NOTE: The following Development Plan Policies were relevant to this decision: Local Development Framework Policies DP1, DP2, DP3, CS9, CS20.
