|---|---|
(1) The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
(2) Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order, 1995, (or any Order revoking or re-enacting that Order) no enlargement of the dwelling(s) or development within the curtilage the subject of this permission shall be carried out without the express consent of the Local Planning Authority. REASON: To safeguard the character and appearance of the development.
(3) No boundary walls/fences shall be erected at the site without the prior written approval of the Local Planning Authority. REASON: In the interests of visual amenity.
(4) No domestic paraphernalia including the installation of washing lines shall be installed/erected within the curtilage of the dwellings hereby approved unless first agreed in writing with the Local Planning Authority. REASON: In the interests of visual amenity.
(5) Notwithstanding the details provided on the submitted plans and elevations, approval of the exact details of the design, materials and external appearance of doors and window frames shall be obtained from the Local Planning Authority prior to the development being commenced. REASON: To ensure the use of satisfactory materials.
(6) Before the development hereby approved is brought into use, provision shall be made for the parking and turning of cars on land within the curtilage of the premises in accordance with a scheme to be agreed in writing with the Local Planning Authority and such provision shall be thereafter retained. REASON: To ensure adequate on-site parking and vehicle turning provision is maintained.
(7) Before the development hereby approved is brought into use, all vehicular surfaces are to be sealed, surfaced and drained to the satisfaction of the local planning authority. REASON: In the interests of highway safety.
(8) Before the development commences details shall be submitted and approved in writing of proposals to provide contractor car parking and materials storage compound for the duration of the works. (Please note it will not be practical for these to be provided on Loy Lane as access is required for both the cemetery and the allotment gardens). REASON: In the interests of highway safety.
ADVISORY NOTE: Loftus Town Council has requested that prior to works commencing a photographic record be made of the existing condition of the chapel as there is a great deal of local interest in local history. It is then requested that this information be made available to Loftus Town Council to archive and the Local History Group.
ADVISORY NOTE: Bats and their roosts are protected by law, which means it is illegal to disturb, kill or injure them, or to damage, destroy or obstruct access to a bat roost, whether intentionally or recklessly. As bats tend to return regularly to favoured roosts, it is important to remember that roosts are protected whether the bats are present or not. The presence of bats does not mean that operations such as building work, roofing and other repairs, floodlighting or timber treatment cannot take place, but Natural England should be consulted, before work starts, to obtain advice.
ADVISORY NOTE: It has been brought to our attention that the existing electricity supply to the chapel building was obtained from the former Cemetery Lodge. It will be necessary to make arrangements for a separate supply to be installed.
NOTE: The following development plan policies were relevant to this decision:- Local Development Framework Policies CS20, DP2, DP3 and DP14.
REASON FOR DECISION: The proposed change of use is considered to be acceptable in this location by virtue of the fact that it would not have an adverse affect on the character or amenity of the area. The proposal does not raise any issues in respect of highway safety or crime prevention. The proposal therefore accords with the Council's adopted Development Plan.
