NT03968/032), the submitted Environmental Statement (October 2007) contained in the planning application. REASON: The development of the site is the subject of an Environmental Impact Assessment and any alteration to the layout, land use or design which is not substantially in accordance with the approved plans may have an impact that has not been assessed by that process.
(4) Prior to the commencement of development of each part of the development for which reserved matters have been approved, details and samples of all materials to be used in the construction of the external surfaces of the buildings shall be submitted to and approved in writing by the Local Planning Authority and the development shall be implemented using the approved materials. REASON: In the interests of the visual amenities of the area and to ensure a satisfactory standard of development is achieved.
(5) Prior to the occupation of each part of the development approved, a travel plan shall be submitted to the Local Planning Authority for formal acceptance and implemented for the development. A detailed travel survey shall be undertaken on an annual basis (at the same time of year) for as long as the development remains occupied. The results of these surveys shall be provided to the local planning authority and used to identify corrective measures should the travel plan fail to comply with the agreed mode share targets and outcomes within specified timescales. REASON: The site may be contaminated as a result of past or current uses and/or is within 250 metres of a site which has been landfilled and the Local Planning Authority wishes to ensure that the proposed development can be implemented and occupied with adequate regard to environmental and public protection.
(24) If, during development, contamination not previously identified is found to be present at the site then no further development (unless otherwise agreed in writing with the Local Planning Authority) shall be carried out until the developer has submitted, and obtained written approval from the Local Planning Authority for, an amendment to the Method Statement detailing how this unsuspected contamination shall be dealt with. REASON: To protect controlled waters
(25) Piling or any other foundation designs using penetrative methods will not be permitted other than with the express written consent of the Local Planning Authority, which may be given for those parts of the site where it has been demonstrated that there is no resultant unacceptable risk to groundwater. REASON: To protect controlled waters
(26) Bat and bird boxes shall be erected at the site in accordance with the details contained in sections 13.5 and 13.7 of the ‘South Tees Eco-Park Non-Technical Summary’ and with a scheme submitted to and approved by the Local Planning Authority. REASON: In the interests of ecology.
(27) No development shall take place on site unless in accordance with the mitigation detailed within the protected species report ‘South Tees Eco-Park Non-Technical Summary’, including, but not restricted to, adherence to timing and spatial restrictions; provision of mitigation in advance; and, adherence to precautionary working methods. REASON: in the interests of ecology.

REASON: In the interests of safety and the free flow of traffic on the A1053 and A174 and their junctions.
6. Network Rail have advised the council of the following matters that may need to be addressed by the developer, and, incorporated: i. All operations, including the use of cranes or other mechanical plant working adjacent to Network Rail’s property, must at all times be carried out in a “fail safe” manner such that in the event of mishandling, collapse or failure, no materials or plant are capable of falling within 3.0m of the nearest railway line, or where the railway is electrified, within 3.0m of overhead electrical equipment or supports. ii. All surface and foul water arising from the proposed works should be collected and diverted away from Network Rail property. iii. All excavations/earthworks carried out in the vicinity of Network Rail property/structures must be designed and executed such that no interference with the integrity of that property/structure can occur. If temporary works compounds are to be located adjacent to the operational railway, these should be included in a method statement for approval by Network Rail. iv. Security of the railway boundary will be required to be maintained at all times. If the works require temporary or permanent alterations to the mutual boundary the applicant must contact Network Rail’s Territory Outside Parties Engineer. v. Method statements will be required to be submitted to Network Rail’s Territory Outside Parties Engineer (29), George Stephenson House, Toft Green, York, YO1 6JT) for approval prior to works commencing on site. Where any works cannot be carried out in a ‘fail-safe’ manner, it will be necessary to restrict those works to periods when the railway is closed to rail traffic which must be booked via Network Rail’s Territory Outside Parties Engineer and are subject to a minimum prior notice period for booking of 20 weeks. vi. Consideration should be given to ensure that the construction and subsequent maintenance can be carried out to any proposed buildings or structures without adversely affecting the safety of, or encroaching upon Network Rail’s adjacent land, and therefore all/any building should be situated at least 2 metres from Network Rail’s boundary. This will allow construction and future maintenance to be carried out from the applicant’s land, thus avoiding provision and costs of railway look-out protection, supervision and other facilities necessary when working from or on railway land. vii. Where new roads, turning spaces or parking areas are to be situated to a railway which is at or below the level of the development, suitable crash barriers or high kerbs should be provided to prevent vehicles accidentally driving/rolling on to the railway or damaging the line side fencing. viii. Where trees/shrubs are to be planted adjacent to the railway boundary these shrubs should be positioned at a minimum distance greater than their predicted mature height from the boundary. Certain broad leaf deciduous species should not be planted adjacent to the railway boundary. ix. If not already in place, the developer must provide a suitable trespass proof fence (of at least 1.8m in height) adjacent to Network Rail’s boundary and make provision for its future maintenance and renewal. Network Rail’s existing fencing/wall must not be removed or damaged. x. Where new lighting is to be erected adjacent to the operational railway the potential for train drivers to be dazzled must be eliminated. In addition the location and colour of lights must not give rise to the potential for confusion with the signalling arrangements on the railway. xi. Network Rail is entitled to recover all reasonable costs associated with facilitating these works.
INFORMATIVES 1. The Council has been advised that power to supply adjacent Corus sites is derived through the application site. It is recommended that the applicant should contact Corus Estates to discuss this matter further.
2. The Environment Agency have advised that surface water drainage from this site is required to be regulated so as not to exacerbate flooding problems downstream within the catchment. The discharge should be regulated to the greenfield run-off from a 1 in 1 year storm and sufficient storage at least to accommodate a 1 in 30 year storm. The design should also ensure that storm water resulting from a 1 in 100 year event and surcharging the drainage system can be stored on the site without risk to people or property and without overflowing into the watercourse.
3. The Environment Agency also encourage the use of SUDS where it is deemed appropriate. Guidance on the use of SUDS and appropriate levels of treatment is available from CIRIA.
4. Any activities involving the storage, treatment or disposal of waste may require a Waste Management Licence or a PPC permit. The applicant is advised to contact the Environment Agency at their earliest convenience to apply for any necessary permits.
5. Natural England have requested the developer take note of the following advice: · The applicant should be aware that planning permission does not remove the requirement to comply with the relevant law, including obtaining and complying with the terms and conditions of any licences required as described in Part IV B of ODPM Circular 06/2005 Biodiversity and Geological Conservation. · The developer may need to obtain a Natural England licence prior to the commencement of works. The developer should be advised by their ecologist with respect to this issue. · A demolition method statement should be written and passed to contractors working on the site on the demolition and construction phases of the development, in order to ensure the safety and habitat of protected species.
REASON FOR DECISION: The proposed development of an Eco-Park at the Corus Prairies site accords with the regional, sub-regional and local planning policy which seeks to encourage such uses within the South Tees Employment Area. The location of the development is such that construction works and the operational development would not impact upon local residents. Subject to the relevant controls the proposal would not have an adverse impact upon protected areas, wildlife or water quality. Subject to some junction improvements, the existing road network has sufficient capacity to accommodate additional road traffic. The proposal therefore represents an appropriate development on previously developed industrial land, and one that will have significant economic and social benefits to the Tees Valley region.
NOTE: The following development plan policies were relevant to this decision:- Local Development Framework Policy CS1, CS2, CS3, CS4, CS10, CS20, CS25, DP2 and DP3.
