| 1 | (1) The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990. |
| 2 | (2) No development approved by this permission shall be commenced until:- (a) The application site has been subjected to a detailed scheme for the investigation and recording of contamination including soil contamination, ground/surface water contamination, landfill gas, leachates and stability as appropriate; (b) Detailed proposals for the removal, containment or otherwise rendering harmless any contamination (the 'Reclamation Method Statement') have been determined through risk assessment and approved in writing by the Local Planning Authority; (c) The works specified in the Reclamation Method Statement have been completed in accordance with the approved scheme; Any contamination not considered in the Reclamation Method Statement but identified during the reclamation works should be subject to further risk assessment and remediation proposals agreed with the Local Planning Authority. A report demonstrating that the works were carried out in accordance with the approved scheme (the 'Validation Report') should be submitted to the Local Planning Authority within 2 months of completion of the development. REASON: The site may be contaminated as a result of past or current uses and/or is within 250 metres of a site which has been landfilled and the Local Planning Authority wishes to ensure that the proposed development can be implemented and occupied with adequate regard to environmental and public protection. |
| 3 | (3) Prior to the commencement of the leachate treatment system full details of the bunding and input flow shall be submitted to the Local Planning Authority for approval in writing. The bunds must be impermeable and be capable of retaining 110% of the largest tank within it and with no outlet through the bund wall. The approved scheme shall be implemented in its entirety. REASON: In the interests of pollution control. |
| 4 | (4) The development shall be undertaken in accordance with the revised plans received on 4 February 2008 and the mitigation outlined in the Ecosurve Ecology Consultants Survey Report submitted on 21 December 2007 unless otherwise first agreed in writing with the Local Planning Authority. REASON: For the avoidance of doubt and to secure the protection of the Great Crested Newt colony. |
| 5 | (5) The development shall not be commenced until a scheme for the provision of a contractors compound and facilities fro the prevention of mud/debris being deposited on the highway has been submitted to the Local Planning Authority for approval in writing. The approved scheme shall be adhered to for the lifetime of the construction period. REASON: In the interests of highway safety and convenience. |
| 6 | (6) The developer shall ensure that the accesses to property along the pipeline route are maintained free of obstruction at all times. REASON: In the interests of highway safety and convenience. |
| 7 | REASON FOR DECISION: The proposed development due to its location, layout and appearance would not create conditions prejudicial to the character or appearance of the area, local amenity, highway safety or protected species. The proposal does not raise issues concerning crime. The proposal therefore accords with the aims of both national and local planning policy. |
