| 1 | (1) The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990. |
| 2 | (2) Before development commences a scheme for protecting the proposed dwelling from noise from the railway shall be submitted to and approved by the Local Planning Authority. The works in the approved scheme shall be carried out before any dwelling to which the scheme relates is occupied. REASON: In the interests of amenity. |
| 3 | (3) Details of a site investigtion and risk assessment sufficient to identify the nature and degree of any contaminants in, on or under land, shall be submitted to and approved by the Local Planning Authority prior to the commencement of any works involving the disturbance of the land. The site investigation shall be carried out as approved. Dependent on the findings of the investigation, a remedition scheme shall be submitted to and approved by the Local Planning Authority. The approved remediation works shall be implemented prior to other development on site commencing. REASON: There is a risk of contamination from previous uses. |
| 4 | (4) Prior to any discharge into any watercourse, surface water sewer or soakaway system, all surface water drainage from parking areasa and hardstandings shall be passed through trapped gullies installed in accordnace with a scheme previously submitted to and approved by the Local Planning Authority. REASON: In the interests of pollution control. |
| 5 | (5) Prior to development commencing the developer shall ensure that where protected species and species listed in the Tees Valley Biodiversity Action Plan and the UK National Biodiversity Action Plan are present at the site, a scheme to mitigate any effects of the proposed development is submitted to and approved by the Local Planning Authority. The scheme shall be implemented as approved. REASON: In the interests of nature conservation. |
| 6 | (6) Details of all boundary walls and/or fences shall be submitted to and approved by the Local Planning Authoirty. The approved scheme shall be implemented. REASON: In the interest of visual and residential amenities. |
| 7 | (7) Details of existing and proposed ground and/or slab levels shall be submitted to and approved by the Local Planning Authority before development commences. The development shall be implemented in accordance with the approved details. REASON: In the interests of visual and residential amenity. |
| 8 | (8) Details of materials to be used on the external elevations of the development shall be submitted to and agreed in writing by the Local Planning Authority prior to the development being commenced. REASON: To ensure the use of satisfactory materials. |
| 9 | (9) Prior to the commencement of the development, details of the methods to be used to protect the existing trees on the site from construction work shall be submitted to and approved in writing by the Local Planning Authority, and such measures as approved shall be carried out before the development commences and maintained throughout the period of construction until the completion of the development. REASON: To ensure that existing trees/hedges on and adjacent to the site which are to be retained, are protected from vehicles and works involved in the construction of the development. |
| 10 | (10) Prior to commencement of development details of a scheme to prevent mud/debris on the public highway during construction shall be submitted to the Local Planning Authoirty for approval in writing. The approved scheme shall be adhered to in its entirety. REASON: In the interest of highway safety. |
| 11 | (11) Prior to the commencement of development details of a site compound shall be submitted to the Local Planning Authority for approval in writing. The approved details shall be adhered to in their entirety. REASON: In the interests of highway safety. |
| 12 | NOTE: The following development plan policies were relevant to this decision:- Local Development Framework Policy CS1, CS6, CS14, CS15, CS17, CS20, DP1, DP2, DP3 and DP7 and Supplementary Planning Guidance Appendix 10 of the Redcar and Cleveland Local Plan. |
| 13 | REASON FOR DECISION: The site is within the limits to development and is previously developed land. The principle of residential development is therefore considered acceptable particularly in view of the previous approvals for this site. The relationship of the proposed dwellings to existing properties on Coach Road is satisfactory. The scheme does not raise issues of highway safety or community safety, The proposal accords with the Council's adopted Development Plan. |
