|---|---|
(1) The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
(2) The restoration of the embankment shall completed within 12 months of the date the access track is first brought into use and shall include replacement fencing and trees in accordance with a scheme that has first been submitted to and agreed in writing with the Local Planning Authority. REASON; To ensure satisfactory restoration of the embankment in the interests of the appearance of the landscape.
Informative: The Council's arborist advises that the replacement trees comprise 2 each of Birch, Ash and Hawthorn.
NOTE: The following development plan policies were relevant to this decision:- Local Development Framework policy CS2, CS6, CS12, CS22 and DP1, of the Redcar and Cleveland Local Plan 1999.
REASON FOR DECISION: The proposed development due to its scale and location would not create conditions prejudicial to the protection of the landscape or prevent the re-use the line of the railway should that ever be necessary. The proposal therefore accords with the aims of the Local Plan 1999 and Local Development Framework.
