| # | Condition Details |
|---|---|
(1) The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
(2) The materials used for the shop front shall be agreed in writing with the Local Planning Authority prior to the commencement of development. REASON: To ensure the use of satisfactory materials.
(3) The premises shall not operate before 09.00 and after 23.30 on any day. REASON: To safeguard the amenity of nearby residential properties.
(4) This permission relates only to the amended plan(s) received by the Local Planning Authority on 24 July 2007. REASON: For the avoidance of doubt.
(5) Any noise emitted from the new units should not contribute any more than 3dB(A) to existing background noise levels, when measured at a distance of 1 metre from the façade of any adjacent dwelling, and when calculated as an Leq(A) of 10 minutes. REASON: To safeguard the living conditions of nearby residents.
(6) Details of any extract ventilation or fume extraction system, including the position of ventilation, fume or flue outlet points and the type of filtration or other fume treatment, to be installed and used in the premises, in pursuance of this permission, shall be first approved by the Local Planning Authority, and installed before the development hereby permitted commences, and thereafter in full accordance with the approved details. REASON: In the interest of the amenities of the area.
(7) The ventilation and extraction system referred to in Condition 6 (above) shall incorporate some sort of filtration system (usually Activated Carbon Filtration) and shall be operated and maintained, in accordance with the manufacturers recommendations including the frequency of replacement filters. REASON: In the interest of the amenities of the area.
REASON FOR DECISION: The proposed use is considered appropriate within the existing commercial centre. It is not considered that a restaurant and takeaway would adversely impact on the character and amenity of the area. The proposed alterations at the rear and to the shop front are not considered likely to have an adverse impact upon the special character of the conservation are. Therefore the proposal accords with the Council's adopted Development Plan.
INFORMATIVE NOTE: This permission relates only to the change of use, rear extension and new shop front, any addition of signage and/or advertisements may require separate consent.
NOTE: Redcar and Cleveland Local Development Framework Policies CS20, CS7, CS18, CS25, DP2, DP3, DP9 and policy SH7 from the 1999 Local Plan were relevant to this decision.
