| 1 | (1) The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990. |
| 2 | (2) Notwithstanding the details of the flue shown on the drawings submitted on the 10 August 2007, a revised scheme showing the flue repositioned away from the first floor window shall be submitted to, and agreed with, the Local Planning Authority prior to the commencement of any development. REASON: To ensure a satisfactory form of development. |
| 3 | (3) The premises shall not be open to customers before 16.00 hours and after 22.00 hours on any day. REASON: In the interest of amenity to the area. |
| 4 | (4) Wash basins should be provided in any rooms that will be used for food handling. REASON: In the interest of food safety. |
| 5 | (5) Arrangements for the storage and disposal of refuse shall be submitted to and agreed in writing with the Local Planning Authority prior to the opening of the hot food takeaway. REASON: In the interest of food safety. |
| 6 | (6) The rear flue shall be built to the following specification: 1. First stage filtration - canopy filter pads (mesh filters will be satisfactory) - to be changed every 2-6 weeks depending on usage of oils in cooking. The filter media shall comply with BS EN 779:2002 of up to G4. 2. Second stage filtration - can be made of same materials as first stage filtration to be changed every 1-3 months depending on amount of grease/oil build up. The filter media shall comply with BS EN 779:2002 of up to G4. 3. Third stage filtration - synthetic bag filters - to be changed every 6 months. The media filter shall comply with BS EN 779:200 of up to F8. 4. Fourth stage filtration - carbon filter - to be changed every 12 months. Effectiveness will depend on frequency of replacement of pre-filters. The ventilation and extraction system shall be operated and maintained, in accordance with the manufacturers recommendations including the frequency of replacement of any filters. REASON: In the interest of the amenity of the area. |
| 7 | REASON FOR DECISION: The proposed use is considered to be appropriate within the local centre as identified in the Council's Proposals Map. Providing a safeguarding condition relating to the flue, it is considered that the use will not cause significant harm to the amenities of local residents as there is already established activity in the area up to the proposed closing time. The proposal therefore accords with the Council's adopted Development Plan. |
