| 2 | REASON FOR DECISION: The premises are in a town centre location where there are few residential uses and where permission was recently granted on appeal for the proposed opening hours at a nearby outlet, 34 Market Place, Guisborough when it was determined no material harm to residential amenity would result. Whilst each case is determined on its merits that recent decision is material to the consideration of this proposal. Where there is insufficient evidence to suggest the opening hours would cause harm, in the interests of natural justice, the proposal should be approved. The proposal would therefore meet the aims of Policies GEN1, GEN2 and SH7 of the Redcar and Cleveland Local Plan 1999. |
