# Condition Details
(1) The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
(2) Details of materials to be used for all hard surfaces shall be submitted to and agreed in writing by the Local Planning Authority prior to the commencement of the development. REASON: To reserve the rights of the Local Planning Authority with regard to these matters.
(3) No development shall take place until there has been submitted to, and agreed in writing by the Local Planning Authority, a scheme of landscaping which shall include indications of all existing trees and hedgerows on the land (if any), and details of any to be retained, together with measures for their protection in the course of the development. It is expected that the submitted landscaping scheme will make provision to replace all trees affected by this development. REASON: To reserve the rights of the Local Planning Authority with regard to these matters
(4) Notwithstanding the provisions of the Town and Country Planning General Development Order, 1988 (or any Order revoking or re-enacting that Order), no fences, gates, or walls shall be erected within the curtilage of any dwellinghouse forward of any walls of that dwellinghouse which front onto a road. REASON: To safeguard the character and appearance of the development.
(5) Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order, 1995, (or any Order revoking or re-enacting that Order) no enlargement of the dwelling(s) the subject of this permission shall be carried out without the express consent of the Local Planning Authority. REASON: To safeguard the character and appearance of the development.
(6) Notwithstanding the detail shown on the submitted drawings, before the development hereby approved is brought into use, provision shall be made for the parking of cars in accordance with a scheme to be agreed in writing with the Local Planning Authority and such provision shall be thereafter retained. REASON: To ensure adequate on-site car parking provision is maintained.
(7) No development shall proceed until the applicant has obtained Works In Rivers Consent from the Environment Agency. REASON: To prevent increased flood risk by ensuring existing river channels are maintained.
(8) No development approved by this permission shall be commenced until a scheme for the provision of surface water drainage works including the necessary attenuation has been approved by the local planning authority. Such a scheme shall be implemented before the construction of impermeable surfaces draining to this system unless otherwise agreed in writing by the local planning authority. REASON: To prevent the increased risk of flooding by ensuring the provision of a satisfactory means of surface water disposal.
(9) No development approved by this permission shall be commenced until a scheme for the storage of building materials, and a scheme for the car parking for construction workers’ vehicles & all construction vehicles is submitted in writing and approved by the local planning authority. REASON: In the interests of highways safety and amenity.
(10) The timber fence to the east of the proposed site entrance should be re-aligned from the point between 34 and 35 East Crescent to lie at a point behind the second electricity pole. REASON: In the interests of highways safety and amenity.
INFORMATIVE NOTES: 1) It is the responsibility of the developer and/or landowner (11) It is the responsibility of the developer and/or landowner (and NOT the local planning authority) to correctly mark out the plot boundaries and the footprint of the proposed dwelling prior to the commencement of construction in order to ensure the dwelling is constructed in the location approved by this permission. 2) The applicant may wish to satisfy himself that all necessary precautions have been taken to prevent vehicular traffic from leaving the un-adopted highway outside 32 to 36 East Crescent and possibly breaching the timber fence. 3) The site is adjacent to Loftus Beck, which is classed as a Main River due to the contribution it makes to flood risk downstream. Under land drainage legislation, any works in under, over or within 8 metres of the bank-top must have the prior written consent of the Environment Agency. Any works undertaken without consent may be removed at the landowner’s expense. 4) The proposed development would significantly increase the run-off rate to the beck, which may cause or exacerbate flooding elsewhere. Therefore surface water run-off should be attenuated to existing greenfield rates. 5) There should be no discharge of foul or contaminated drainage from the site into either groundwater or any surface waters, whether direct or via soakaways to prevent the pollution of the water environment. See the website at www.environment-agency.gov.uk. 6) Site operators should ensure that there is no possibility of contaminated water entering and polluting surface or underground waters. 7) Any queries regarding informatives 3 to 6 should be addressed to the Environment Agency for the attention of Jonathan Kendall (jonathan.kendall@environment-agency.gov.uk / 01904 822603).
REASON FOR DECISION: The site is within the limits to development as set out in the Council's Local Plan. The layout and design are acceptable and accords with the guidance set out in the Local Plan. The development respects the amenity and character of the area. The application does not raise any issues in respect of crime prevention or highway safety. The proposal therefore accords with the Council's Local Plan.
NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2, LD1, H2, H3, H5 and T6 were relevant to this decision.
