# Condition Details
(1) The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
(2) This permission relates only to the amended plans received by the Local Planning Authority on 12 and 18 July 2007 respectively. REASON: For the avoidance of doubt.
(3) No development approved by this permission shall be commenced until:- (a) The application site has been subjected to a detailed scheme for the investigation and recording of contamination including soil contamination, ground/surface water contamination, landfill gas, leachates and stability as appropriate; (b) Detailed proposals for the removal, containment or otherwise rendering harmless any contamination (the 'Reclamation Method Statement') have been determined through risk assessment and approved in writing by the Local Planning Authority; (c) The works specified in the Reclamation Method Statement have been completed in accordance with the approved scheme;
Any contamination not considered in the Reclamation Method Statement but identified during the reclamation works should be subject to further risk assessment and remediation proposals agreed with the Local Planning Authority. A report demonstrating that the works were carried out in accordance with the approved scheme (the 'Validation Report') should be submitted to the Local Planning Authority within 2 months of completion of the development. REASON: The site may be contaminated as a result of past or current uses and/or is within 250 metres of a site which has been landfilled and the Local Planning Authority wishes to ensure that the proposed development can be implemented and occupied with adequate regard to environmental and public protection.
(4) The retail floorspace shall not be used for: a) The sale of food (other than confectionary, food or drink associated with or ancillary to the main operations); or b) The sale of clothing & shoes, fashion accessories including handbags and luggage, watches and jewellery; or c) The sale of pharmaceutical & personal care products, including perfumes, toiletries, spectacles and contact lenses; or d) The sale of toys, books, music, records, CD's, DVD's, videos and audio tapes, other than ancillary to the main operations; or e) The sale of china, fancy goods and gift ware. REASON: The site is not considered appropriate for general retail purposes.
(5) A revised Travel Management Plan must be submitted to and approved in writing within three months of the opening of the retail unit which demonstrates exactly how all staff and customers travel to and from the site and actions undertaken to ensure this is in a sustainable manner. REASON: In the interests of sustainable travel.
(6) Details of materials to be used on the external elevations of the development shall be submitted to and agreed in writing by the Local Planning Authority prior to the development being commenced. REASON: To ensure the use of satisfactory materials.
REASON FOR DECISION: The proposed development is considered to be appropriate within this existing commercial centre. It would not have an adverse impact on the character and amenity of the area. The application does not raise any issues in respect of crime prevention or adversely affect highway safety. The proposal accords with the Council's adopted Development Plan.
The following development plan policies were relevant to this decision:- Supplementary Planning Guidance: Appendix 7: Local Plan Adopted Local Development Plan: Core Strategy - Development Plan Document CS1 (8); CS2 (Locational Strategy); CS20 (Promoting Good Design); CS25 (Built & Historic Environment); CS26 (Managing Travel Demand) Development Policies - Development Plan Document DP1 (Development Limits); DP2 (Site Selection); DP3 (Sustainable Design) DP7 (Contaminated Land)
INFORMATIVES: It is recognised that the Travel Plan for the whole Retail Park is a document that will be updated as and when uses are introduced and/or changed across the Retail Park due to the uncertain nature of exactly where future employees will come from. Notwithstanding this and the condition above, the following changes should be made in any revised Travel Plan document: (Section 6e, 10f) Should not be limited to 20 minimum members of staff working in the store at any one time as these services/resources can be provided currently by RCBC; (Section 13-16) RCBC can provide a car sharing database for staff from the park to use (www.2plustravel.com) and subject to a small annual fee can provide a private grouping for park employees only. This information needs to be incorporated into the document; (Section 20) The words Middlesbrough Borough Council should be removed and replaced with Redcar & Cleveland Borough Council. 2) Consideration should be given as to how the manual handling of stock by employees can be minimised due to the presence of a mezzanine floor. 3) Consideration should be given to the use of a pallet access gate being built into the design of the mezzanine floor to protect personnel.
