# Condition Details
1 (1) The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
2 (2) Details of materials to be used on the external elevations of the development shall be submitted to and agreed in writing by the Local Planning Authority prior to the development being commenced. REASON: To ensure the use of satisfactory materials.
3 (3) No development shall take place until there has been submitted to, and agreed in writing by the Local Planning Authority, a scheme of landscaping which shall include indications of all existing trees and hedgerows on the land (if any), and details of any to be retained, together with measures for their protection in the course of the development. REASON: To reserve the rights of the Local Planning Authority with regard to these matters
4 (4) All planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting and seeding season following the occupation of the buildings or the completion of the development, whichever is sooner, and any trees or plants which within a period of five years from the completion of the development die, are removed, or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species unless the Local Planning Authority gives written consent to any variation. REASON: To ensure the satisfactory implementation of the approved scheme in the interests of the visual amenities of the locality.
5 (5) This permission relates to the scheme as amended by plans and documentation received on 12 and 22 November 2007. REASON: For the avoidance of doubt.
6 (6) The mitigation outlined in the E3 Ecology Ltd report 'An Ecological Assessment Survey of an Area of Land within Skelton, Redcar and Cleveland' of May 2007 shall be adhered to and the final details shall have first ben agreed in writing with the Local Planning Authority. REASON: In the interests of nature conservation.
7 (7) The mitigation and recommendations in the QEM Ltd report reference BH/CH/02/06 regarding noise and vibration shall be adhered to. REASON: In the interest of residential amenity.
8 (8) Details of boundary walls/fences and retaining walls to be erected as part of this development shall be submitted to and agreed in writing by the Local Planning Authority prior to the development being commenced. REASON: To ensure the use of satisfactory materials.
9 (9) The development shall be carried out in accordance with the additional details contained in letter dated 11 Septemer 2007, reference PT/Eng232.1/JDM to the Environment Agency. REASON: In the interests of flood protection and for the avoidance of doubt.
10 (10) Prior to the first occupation of any part of the development the 13 no dwellings required to be provided pursuant to the S106 shall be identified and the mechanism for delivery shall be agreed with the Local Planning Authority. REASON: 13 affordable dwellings are required to be provided pursuant to the S106 Agreement.
11 (11) Prior to the commencement of development details of a scheme to prevent mud/debris being deposited on the highway shall have been submitted to and agreed in writing with the Local Planning Authority. The approved scheme shall be adhered to throughout the construction period. REASON: In the interests of highway safety.
12 (12) Prior to the commencement of development a contractors compound shall have been provided in accordance with details that have first been agreed in writing with the Local Planning Authority. The compound shall be available throughout the period of construction. REASON: In the interests of highway safety.
13 (13) Prior to the commencement of development details of a Traffic Management Scheme shall have been submitted to and approved in writing by the Local Planning Authority. The approved scheme shall be adhered to during the construction period. REASON: In the interests of highway safety.
14 NOTE: The following development plan policies were relevant to this decision:- Local Development Framework Policies CS1, CS2, CS6, CS13, CS14, CS15, CS17, CS19, CS20, CS24, CS26, DP1, DP2, DP3 and DP6.
15 REASON FOR DECISION: The principle of developing these sites for residential purposes was established by virtue of the outline consent granted in 1994. The proposed layout is considered to be acceptable in highway terms. The design of the proposed dwellings and the density of development is appropriate in this location. The relationship with existing properties is satisfactory. The proposal accords with the Council's adopted Development Plan.
