| 9 | INFORMATIVE: The proposed plan (Ref. 2095/K, drawing number 201) shows an all-weather covered garden surrounded on three sides by trellis and vegetation. Under the smoke-free legislation, smoking will not be permitted in substantially enclosed premises. In my opinion, on the basis of the drawing, the all-weather garden will be classed as substantially enclosed because more than 50% of the walls are permanently enclosed. Further information on the forthcoming legislation can be obtained from www.smokefreeengland.co.uk or the Health and Safety Team on 0845 126 126. |

| 11 | REASON FOR DECISION: The siting and design of the covered garden area is considered acceptable in terms of the impact upon the character and appearance of the area. Given the location and the separation distance to nearby residential properties it is not considered that the development will impact upon local residential amenity to an unacceptable degree. The Scheme does not affect access or vehicular parking within the site. |
