# Condition Details
(1) The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
(2) Details of materials to be used on the external elevations of the development shall be submitted to and agreed in writing by the Local Planning Authority prior to the development being commenced. REASON: To ensure the use of satisfactory materials.
(3) Details of materials to be used for all hard surfaces shall be submitted to and agreed in writing by the Local Planning Authority prior to the commencement of the development. REASON: To reserve the rights of the Local Planning Authority with regard to these matters.
(4) Other than those shown on the approved plans, no windows or doors shall be inserted into the gable (side) elevations of the dwellings hereby approved, unless first agreed otherwise in writing with the Local Planning Authority. REASON: In the interests of neighbour amenity.
(5) The en-suite windows in the first floor of the gable (side) elevations of the dwellings hereby approved, and any subsequent replacements, shall be glazed throughout with obscured glazing and thereafter retained as such, unless first agreed otherwise in writing with the Local Planning Authority. REASON: In the interests of neighbour amenity.
(6) Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order, 1995 the garage shall not be used for any purpose (including a purpose ordinarily incidental to the enjoyment of the dwellinghouse) which would preclude its use for the accommodation of a private motor vehicle. REASON: In the opinion of the Local Planning Authority the retention of the garage for the parking of a private vehicle is important in safeguarding the appearance of the locality and highway safety.
(7) The development hereby approved shall not commence until such time as a scheme for landscaping of the site has been submitted to and approved in writing by the Local Planning Authority. Any scheme submitted under the requirements of this condition shall include details of numbers, species and sizes of trees and shrubs to be retained and planted and any arrangements for the future maintenance of the area. REASON: To ensure that the development is of attractive appearance in the interests of visual amenity.
(8) The landscaping scheme required by condition 7 above, shall be implemented during the first planting season following completion of the development hereby approved and shall thereafter be retained and maintained as such. Any trees or shrubs planted in accordance with this condition shall, in the event of their death within 5 years from date of their planting, be replaced by similar specimens as soon as practicably possible and no later than the end of the planting season following death. REASON: To ensure that the development is of attractive appearance in the interests of the visual amenity.
(9) No development approved by this permission shall be commenced until:- (a) The application site has been subjected to a detailed scheme for the investigation and recording of contamination including soil contamination, ground/surface water contamination, landfill gas, leachates and stability as appropriate; (b) Detailed proposals for the removal, containment or otherwise rendering harmless any contamination (the 'Reclamation Method Statement') have been determined through risk assessment and approved in writing by the Local Planning Authority; (c) The works specified in the Reclamation Method Statement have been completed in accordance with the approved scheme; Any contamination not considered in the Reclamation Method Statement but identified during the reclamation works should be subject to further risk assessment and remediation proposals agreed with the Local Planning Authority. A report demonstrating that the works were carried out in accordance with the approved scheme (the 'Validation Report') should be submitted to the Local Planning Authority within 2 months of completion of the development. REASON: The site may be contaminated as a result of past or current uses and/or is within 250 metres of a site which has been landfilled and the Local Planning Authority wishes to ensure that the proposed development can be implemented and occupied with adequate regard to environmental and public protection.
NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2, LD1 and H3 were relevant to this decision.
REASON FOR DECISION: It is considered that the proposed development will not cause significant harm to the amenities of local residents or adversely affect the character and appearance of the area. The application does not raise any issues in respect of crime prevention or highway safety. The proposal accords with the Council's Local Plan.
