# Condition Details
1 (1) The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
2 (2) The colour of the curved feature wall and rendered walls shall be agreed with the Local Planning Authority. REASON: To ensure a satisfactory form of development.
3 (3) All planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting and seeding season following the occupation of the buildings or the completion of the development, whichever is sooner, and any trees or plants which within a period of five years from the completion of the development die, are removed, or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species unless the Local Planning Authority gives written consent to any variation. REASON: To ensure the satisfactory implementation of the approved scheme in the interests of the visual amenities of the locality.
4 (4) Details of the fencing / walling shall be submitted to and agreed in writing with the Local Planning Authority before development commences. REASON: To ensure a satisfactory form of development.
5 (5) The development shall not be commenced until either:- a) Improvement works (which expression shall include traffic control measures) to the highways specified below have been carried out to enable such highways to accommodate the increase in traffic, which in the opinion of the Council will be generated by the development, or b) Details have been submitted to and approved by the Council of the arrangement which will secure that such improvement works will be carried out prior to any part of the development being used. West Dyke Road / site access West Dyke Road / Kirkleatham lane junction REASON: In the interests of highway safety.
6 (6) Sightlines of 4.5 m x 90 m shall be provided to both accesses to West Dyke Road prior to the accesses coming into use and thereafter be retained. REASON: In the interests of highway safety.
7 (7) During construction work on site should only take place between the hours of 08:00 and 18:00 Monday to Friday, 08:00 and 13:00 Saturdays, and no work should taken place on Sundays or Bank Holidays. During construction no burning of any waste material should take place on site. REASON: In the interests of the amenities of local residents.
8 (8) Any installations of plant, machinery, or extract ventilation (including any fans), should be checked for potential levels of noise emanating from the premises. Any noise emitted from the new units should not contribute any more than 3 dB(A) to existing background noise levels, when measured at a distance of 1 meter from the façade of any adjacent dwelling, and when calculated as an Leq(A) of 10 minutes. REASON: In the interests of the amenities of local residents.
9 (9) Details of any extract ventilation or fume extraction system, including the position of ventilation, fume or flue outlet points and the type of filtration or other fume treatment, to be installed, and used in the premises, in pursuance of this permission, shall be first approved by the Local Planning Authority, and installed before the development hereby permitted commences, and thereafter retained in full accordance with the approved details. REASON: In the interests of the amenities of local residents.
10 (10) The ventilation and extraction system referred to in Condition 9 shall incorporate some sort of filration system (usually Activated Carbon Filtration) and shall be operated and maintained, in accordance with the manufacturers recommendations including the frequency of replacement of any filters. REASON: In the interests of the amenities of local residents.
11 (11) This permission does not relate to the peripheral mounding shown on the submitted drawings. REASON: For the avoidance of doubt.
12 (12) Before development commences details of the finished floor levels of the building and the site levels of the car parking area shall be submitted to and agreed in writing with the Local Planning Authority. REASON: To ensure a satisfactory form of development.
13 (13) Should charges for parking with the site be introduced, the developer shall fund the introduction of a residents parking zone and contribute to on-going enforcement costs in patrolling the area in accordance with a scheme to be agreed with the Local Authority. REASON: In the interests of highway safety.
14 (14) No building works shall take place within the easement of the water main which crosses the application site. REASON: To ensure a satisfactory form of development.
15 REASON FOR DECISION: The principle of developing this site as a medical centre has been established by virtue of the outline consent. The detailed design and layout of the building is considered to be acceptable. The relationship to existing properties is such that it is not considered to impact on these residents to an unacceptable degree. The development is considered acceptable from a highways point of view and does not raise issues of community safety.
16 NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2, LD1 and L1 were relevant to this decision.
