(1) Approval of the details of the siting, design, external appearance of the buildings and the landscaping of the site (hereinafter called "the reserved matters") shall be obtained from the Local Planning Authority before the expiration of three years from the date of this permission. REASON: To reserve the rights of the Local Planning Authority with regard to these matters.
(2) The development hereby permitted shall be begun not later than the expiration of two years from the final approval of the reserved matters or, in the case of approval on different dates, the final approval of the last such matter to be approved. REASON : Required to be imposed pursuant to Section 92 of the Planning & Compulsory Purchase Act 2004.
(3) This permission relates only to the amended plan(s) received by the Local Planning Authority on 5 February 2007. REASON: For the avoidance of doubt.
(4) A visibility splay shall be provided as indicated on the approved plans. The visibility splay shall be thereafter retained and no obstruction of any description shall be allowed within the visibility splay above a height of 900mm. REASON: In the interests of highway safety.
(5) Before the development commences, details of a scheme to provide a 2-metre footway along the High Street in front of No.s 69 and 71, are to be submitted to and agreed in writing by the Local Planning Authority and thereafter constructed in accordance with the agreed scheme before the dwellings hereby approved are occupied. REASON: In the interests of highway safety.
(6) Details of floor levels of each dwelling shall be submitted to and agreed with the Local Planning Authority as part of the Reserved Matters application. REASON: To ensure a satisfactory form of development.
(7) The developer shall give two weeks notice in writing of commencement of works to Tees Archaeology, Sir William Gray House, Clarence Road, Hartlepool, TS24 8BT, Tel: (01429) 523458, and shall afford access at all reasonable times to Tees Archaeology and shall allow observation of the excavations and recording of items of interest and finds. REASON: The site is of archaeological interest.
(8) Prior to the commencement of any development, a full bat survey is to be undertaken during the breeding season (late April - September). This survey shall include emergence surveys and any necessary mitigation proposals. The survey is to be submitted to and agreed in writing by the Local Planning Authority prior to the commencement of any development. REASON: To ensure the protection of a protected species.
(9) The dwellings shall be no higher than two-storey. REASON: In the interests of the amenities of adjoining residents.
(10) No development approved by this permission shall be commenced until:- (a) The application site has been subjected to a detailed scheme for the investigation and recording of contamination including soil contamination, ground/surface water contamination, landfill gas, leachates and stability as appropriate; (b) Detailed proposals for the removal, containment or otherwise rendering harmless any contamination (the 'Reclamation Method Statement') have been determined through risk assessment and approved in writing by the Local Planning Authority; (c) The works specified in the Reclamation Method Statement have been completed in accordance with the approved scheme;
Any contamination not considered in the Reclamation Method Statement but identified during the reclamation works should be subject to further risk assessment and remediation proposals agreed with the Local Planning Authority. A report demonstrating that the works were carried out in accordance with the approved scheme (the 'Validation Report') should be submitted to the Local Planning Authority within 2 months of completion of the development. REASON: The site may be contaminated as a result of past or current uses and/or is within 250 metres of a site which has been landfilled and the Local Planning Authority wishes to ensure that the proposed development can be implemented and occupied with adequate regard to environmental and public protection.
(12) All demolition and construction activities on this site shall only take place between 08:00 and 18:00 Mondays to Fridays, 08:00 to 13:00 on Saturdays and not at all on Bank Holidays and Sundays. REASON: In the interests of the amenities of local residents.
REASON FOR DECISION: The site is within the limits to development and is in an established residential area. The site currently forms private garden land and is classed as brownfield. Therefore the principle of residential development is considered acceptable. The proposed access arrangements are satisfactory. Accordingly the proposal would not be detrimental to highway safety. The proposal therefore accords with the Council's adopted Local Plan.
NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2, LD1, H3 and T6 were relevant to this decision.
