# Condition Details
() No development shall take place until there has been submitted to, and agreed in writing by the Local Planning Authority, a scheme of landscaping which shall include indications of all existing trees and hedgerows on the land (if any), and details of any to be retained, together with measures for their protection in the course of the development. REASON: To reserve the rights of the Local Planning Authority with regard to these matters
(2) A minimum of two car parking spaces shall be provided within the curtilage of each dwelling before being first occupied and thereafter maintained to the satisfaction of the Local Planning Authority. REASON: To ensure that there is adequate on-site car parking to serve the development.
(3) Details of materials to be used on the external elevations of the development shall be submitted to and agreed in writing by the Local Planning Authority prior to the development being commenced. REASON: To ensure the use of satisfactory materials.
(4) Details of materials to be used for all hard surfaces shall be submitted to and agreed in writing by the Local Planning Authority prior to the commencement of the development. REASON: To reserve the rights of the Local Planning Authority with regard to these matters.
(5) This permission relates only to the amended plan(s) received by the Local Planning Authority on 23 November 2006. REASON: For the avoidance of doubt.
(6) All windows in the side elevations of all properties, and any subsequent replacements, shall be glazed throughout with obscure glass and thereafter retained to the satisfaction of the Local Planning Authority. REASON: To safeguard the living conditions of the occupants of adjacent residential properties.
(7) Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order, 1995 the garage shall not be used for any purpose (including a purpose ordinarily incidental to the enjoyment of the dwellinghouse) which would preclude its use for the accommodation of a private motor vehicle. REASON: In the opinion of the Local Planning Authority the retention of the garage for the parking of a private vehicle is important in safeguarding the appearance of the locality and highway safety.
(8) Notwithstanding the provisions of the Town and Country Planning General Development Order, 1988 (or any Order revoking or re-enacting that Order), no fences, gates, or walls shall be erected within the curtilage of any dwellinghouse forward of any walls of that dwellinghouse which front onto a road. REASON: To safeguard the character and appearance of the development.
(9) Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order, 1995, (or any Order revoking or re-enacting that Order) no enlargement of the dwelling(s) the subject of this permission shall be carried out without the express consent of the Local Planning Authority. REASON: To safeguard the character and appearance of the development.
(10) No development approved by this permission shall be commenced until:- (a) The application site has been subjected to a detailed scheme for the investigation and recording of contamination including soil contamination, ground/surface water contamination, landfill gas, leachates and stability as appropriate; (b) Detailed proposals for the removal, containment or otherwise rendering harmless any contamination (the 'Reclamation Method Statement') have been determined through risk assessment and approved in writing by the Local Planning Authority; (c) The works specified in the Reclamation Method Statement have been completed in accordance with the approved scheme; Any contamination not considered in the Reclamation Method Statement but identified during the reclamation works should be subject to further risk assessment and remediation proposals agreed with the Local Planning Authority. A report demonstrating that the works were carried out in accordance with the approved scheme (the 'Validation Report') should be submitted to the Local Planning Authority within 2 months of completion of the development. REASON: The site may be contaminated as a result of past or current uses and/or is within 250 metres of a site which has been landfilled and the Local Planning Authority wishes to ensure that the proposed development can be implemented and occupied with adequate regard to environmental and public protection.
(11) The development shall not be used until visibility splays have been provided as indicted on the revised plans received on 23 November 2006 to the satisfaction of the Local Planning Authority. REASON: In the interests of highway safety.
(12) All visibility splays on the approved plans shall be permanently retained with no obstruction of any description within them above a height of 900mm. REASON: In the interests of highway safety.
INFORMATIVE: It is the responsibility of the developer and/or landowner (13) to correctly mark out the plot boundaries and the footprint of the proposed dwellings prior to the commencement of construction in order to ensure the dwellings are constructed in the location approved by this permission.
NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2, H1(14), H2, H3 and H5 were relevant to this decision.
REASON FOR DECISION: The site is within the limits to development as set out in the Council's Local Plan. The layout and design are acceptable and accords with the guidance set out in the Local Plan. The development respects the amenity and character of the area. The application does not raise any issues in respect of crime prevention or highway safety. The proposal therefore accords with the Council's Local Plan.
