(1) The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
(2) Details of materials to be used on the external elevations of the development shall be submitted to and agreed in writing by the Local Planning Authority prior to the development being commenced. REASON: To ensure the use of satisfactory materials.
(3) This permission relates only to the amended plan(s) received by the Local Planning Authority on 13 December 2006. REASON: For the avoidance of doubt.
(4) No development shall take place until there has been submitted to, and agreed in writing by the Local Planning Authority, a scheme of landscaping which shall include indications of all existing trees and hedgerows on the land (if any), and details of any to be retained, together with measures for their protection in the course of the development. REASON: To reserve the rights of the Local Planning Authority with regard to these matters
(5) No development approved by this permission shall be commenced until a scheme for the provision and implementation of a surface water run-off limitation has been submitted to and approved in writing by the Local Planning Authority. The scheme shall be implemented in accordance with the approved programme and details. REASON: To prevent the increased risk of flooding.
(6) Floor levels should be set at a minimum of 90.50 metres above Ordnance Datum. REASON: To protect the development from flooding.
(7) Development shall not commence untill details of a safe exit route, not adversely affecting the flood regime, to land outside the 1 in 100 year flood plain, are submitted to and agreed in writing by the Local Planning Authority. This route must be in place before any occupancy of the building(s). REASON: To provide safe access and egress during flood events and reduce reliance on emergency services.
(8) Prior to the commencement of any works on site, a settlement facility for the removal of suspended solids from surface water run-off during construction works shall be provided in accordance with details previously submitted to and approve in writing by the Local Planning Authority. The approved scheme shall be retained throughout the construction period. REASON: To prevent pollution of the water environment.
(9) All planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting and seeding season following the occupation of the buildings or the completion of the development, whichever is sooner, and any trees or plants which within a period of five years from the completion of the development die, are removed, or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species unless the Local Planning Authority gives written consent to any variation. REASON: To ensure the satisfactory implementation of the approved scheme in the interests of the visual amenities of the locality.
(10) Details of the boundary means of enclosure shall be submitted to and approved by the Local Planning Authority and thereafter implemented before the apartments are first brought into use. REASON: To reserve the rights of the Local Planning Authority with regard to these matters.
REASON FOR DECISION: The site is within the limits to development as set out in the Council's Local Plan. The layout and design are acceptable and accords with the guidance set out in the Local Plan. The development respects the amenity and character of the area. The application does not raise any issues in respect of crime prevention or highway safety. The proposal therefore accords with the Council's Local Plan.
NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2 and H3 were relevant to this decision.
