| # | Condition Details |
|---|---|
(1) The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
(2) The premises shall be closed to customers before 10:00 and after 23:30 on any day. REASON: In the interest of the amenities of the area.
(3) Any noise emitted from the new units should not contribute any more than 3dB(A) to existing background noise levels, when measured at a distance of 1 metre from the façade of any adjacent dwelling, and when calculated as an Leq(A) of 10 minutes. REASON: In the interest of the amenities of the area.
(4) Details of any extract ventilation or fume extraction system, including the position of ventilation, fume or flue outlet points and the type of filtration or other fume treatment, to be installed, and used in the premises, in pursuance of this permission, shall be first approved by the Local Planning Authority, and installed before the development hereby permitted commences, and thereafter retained in full accordance with the approved details. REASON: In the interests of the amenities of the area.
(5) Members of the public will not be permitted to access or egress from the building via the ground floor rear exits, except in the case of an emergency. REASON: In the interest of the amenities of the occupiers of nearby residential properties.
(6) Notwithstanding the details submitted on the approved plan, details of the proposed canopy are to be submitted to and agreed in writing by the Local Planning Authority prior to the development being first operated. REASON: To ensure a satisfactory form of development.
(7) Before the development hereby approved is brought in to use, an access statement indicating how the approved use is to be serviced shall be submitted to and agreed in writing by the Local Planning Authority. REASON: In the interests of highway safety.
(8) No music shall be played in the roof terrace area either directly or via loudspeakers. REASON: In the interests of the amenities of the area.
REASON FOR DECISION: The proposed use is considered appropriate within this existing commercial centre. Whilst it is noted that there are several other public houses in the immediate vicinity, it is not considered that an additional public house would adversely impact on the character and amenity of the area to an unacceptable degree. The proposed alterations will preserve the character of the listed building. The proposal therefore accords with the Council's adopted Local Plan.
NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2, SH7, ENV4, ENV5 and ENV20 were relevant to this decision.
