| 3 | INFORMATIVES: 1. The applicant is advised to contact the Food Safety Unit at this authority (3) with regard to legal requirements involved in the operation of this use and the requirement for the provision of a hand basin. 2. Any installations of plant, machinery, extract ventilation, fume extraction (including any fans) or flue outlet points may require planning permission and thus proposals for all such installations should be submitted to the Planning Unit and Environmental Health Unit prior to installation in order to assess whether any formal permissions are required. 3. All installations referred to in Informative 2 above would be required to be operated and maintained in full accordance with any manufacturers’ recommendations including the frequency of replacement of filters. 4. All installations referred to in Informative 2 above would be required to be checked for potential noise levels emitted. Any noise emitted should not contribute more than 3dB(A) to existing background noise levels (when measured at a distance of 1 metre from the façade of any adjacent dwelling and when calculated as a Leq(A) of 10 minutes (for further information contact the Environmental Protection Unit: Hazel Snowdon). 5. Should the applicant wish to open beyond the hours covered by Condition 2 above then a variation of condition planning application would be required. 6. Should the applicant wish to open beyond 23:00 hours then, notwithstanding the requirement under Informative 5 above then a Premises Licence would also be required under the Licensing Act 2003. |

| 5 | REASON FOR DECISION: The proposed change of use is considered to be acceptable in this location by virtue of the fact that it would not have an adverse affect on the character or amenity of the area. The proposal does not raise any issues in respect of highway safety or crime prevention. The proposal therefore accords with the Council's adopted Local Plan. |
