Conditions table
# Condition Details
(1) The development hereby permitted shall be begun not later than the expiration of two years from the final approval of the reserved matters or, in the case of approval on different dates, the final approval of the last such matter to be approved. REASON: Required to be imposed pursuant to Section 92 of the Planning and Compulsory Purchase Act 2004.
(2) Approval of the details of the siting, design, and external appearance of the building(s), the means of access thereto and the landscaping of the site (hereinafter called "the reserved matters") shall be obtained from the Local Planning Authority before the expiration of three years from the date of this permission. REASON: To reserve the rights of the Local Planning Authority with regard to these matters.
(3) The reserved matters application shall include details of the proposed highway works including crossing facilities and right turn facility; construction access; the siting of the contractors compound and details of the floor levels of the finished development. REASON: In the interests of pedestrian and highway safety.
(4) No development approved by this permission shall be commenced until:- (a) The application site has been subjected to a detailed scheme for the investigation and recording of contamination including soil contamination, ground/surface water contamination, landfill gas, leachates and stability as appropriate; (b) Detailed proposals for the removal, containment or otherwise rendering harmless any contamination (the 'Reclamation Method Statement') have been determined through risk assessment and approved in writing by the Local Planning Authority; (c) The works specified in the Reclamation Method Statement have been completed in accordance with the approved scheme; Any contamination not considered in the Reclamation Method Statement but identified during the reclamation works should be subject to further risk assessment and remediation proposals agreed with the Local Planning Authority. A report demonstrating that the works were carried out in accordance with the approved scheme (the 'Validation Report') should be submitted to the Local Planning Authority within 2 months of completion of the development. REASON: The site may be contaminated as a result of past or current uses and/or is within 250 metres of a site which has been landfilled and the Local Planning Authority wishes to ensure that the proposed development can be implemented and occupied with adequate regard to environmental and public protection.
(5) Prior to commencement of the development/use a specialist turfgrass consultant shall undertake a detailed assessment of the retained playing field's quality. A detailed drainage and maintenance scheme based upon this assessment, to include an implementation programme, shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of development. The retained playing field area improvements will take place in accordance with the approved scheme prior to the loss of any part of the existing playing field area. REASON: To ensure that adequate playing field provision is maintained.
(6) The reserved matters application shall make provision for indoor and/or outdoor sports faciliteis which are of sufficient benefit to sport so as to outweigh the loss of playing field area proposed in this development. REASON: To ensure a satisfactory form of development.
(7) No development approved by this permission shall be commenced until a scheme for the provision and implementation of a surface water run-off limitation has been submitted to and approved in writing by the Local Planning Authority. The scheme shall be implemented in accordance with the approved programme and details. REASON: To prevent the increased risk of flooding.
(8) Prior to being discharged into any watercourse, surface water sewer or soakaway system, all surface water drainage from parking areas and hardstandings shall be passed through trapped gullies installed in accorance with a schem previously submitted to and approved in writing by the Local Planning Authority. REASON: To prevent pollution of the water environment.
(9) A revised Travel Plan shall be agreed in writing with the Local Planning Authority prior to the use hereby approved commencing. REASON: In the interests of promoting sustainable travel arrangements.
(10) Wheel washing facilities shall be provided within the site to the satisfaction of the Local Planning Authority throughout the construction period. REASON: In the interests of the amenities of the area.
REASON FOR DECISION: The application is for consent to redevelop the site to provide new secondary and primary schools. The principle of developing the site for this purpose is acceptable. The assessment of traffic generation acknowledges that there will be some increase in traffic flows as a result of the development but not sufficient to justify refusal on highway grounds. The siting of the proposed development will not have an adverse impact on adjacent residential properties and the detailed design would be the subject of a further formal application.
INFORMATIVE: There is an existing public sewer within the application site. The development may affect the sewer and no buildings will be allowed within at least 3 metres of the sewer. Early contact with the Northumbrian Water Limited is advised.
NOTE: Redcar and Cleveland Local Plan Policies GEN1 & GEN2 were relevant to this decision.
