# Condition Details
(1) The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
(2) Details of materials to be used on the external elevations of the development shall be submitted to and agreed in writing by the Local Planning Authority prior to the development being commenced. REASON: To ensure the use of satisfactory materials.
(3) This permission relates only to the amended plan(s) received by the Local Planning Authority on 14/7/06. REASON: For the avoidance of doubt.
(4) No development shall take place until there has been submitted to, and agreed in writing by the Local Planning Authority, a scheme of landscaping which shall include indications of all existing trees and hedgerows on the land (if any), and details of any to be retained, together with measures for their protection in the course of the development. REASON: To reserve the rights of the Local Planning Authority with regard to these matters
(5) All planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting and seeding season following the occupation of the buildings or the completion of the development, whichever is sooner, and any trees or plants which within a period of five years from the completion of the development die, are removed, or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species unless the Local Planning Authority gives written consent to any variation. REASON: To ensure the satisfactory implementation of the approved scheme in the interests of the visual amenities of the locality.
(6) No development approved by this permission shall be commenced until: (a) The application site has been subjected to a detailed scheme for the investigation and recording of contamination including soil contamination, ground/surface water contamination, landfill gas, leachates and stability as appropriate; (b) Detailed proposals for the removal, containment or otherwise rendering harmless any contamination (the 'Reclamation Method Statement') have been determined through risk assessment and approved in writing by the Local Planning Authority; (c) The works specified in the Reclamation Method Statement have been completed in accordance with the approved scheme; Any contamination not considered in the Reclamation Method Statement but identified during the reclamation works should be subject to further risk assessment and remediation proposals agreed with the Local Planning Authority. A report demonstrating that the works were carried out in accordance with the approved scheme (the 'Validation Report') should be submitted to the Local Planning Authority within 2 months of completion of the development. REASON: The site may be contaminated as a result of past or current uses and/or is within 250 metres of a site which has been landfilled and the Local Planning Authority wishes to ensure that the proposed development can be implemented and occupied with adequate regard to environmental and public protection.
(7) The developer shall give two weeks notice in writing of commencement of works to the archaeologist nominated by the Local Planning Authority and shall afford access at all reasonable times to the archeologist and shall allow him to observe the excavations and record items of interest and finds. REASON: The site is of archaeological interest.
(8) Prior to commencement of any works on site a traffic management plan for all phases of development shall be submitted for approval in writing by the Local Planning Authority. The approved scheme shall be implemented in its entirety and shall be adhered to for the lifetime of the development. REASON: In the interests of highway safety.
(9) No works shall commence on site until the completion of a Bat Survey and any appropriate mitigation measures are first submitted to the Local Planning Authority for approval in writing. Any mitigation shall be strictly adhered to. REASON: To protect bats where present.
(10) Details of materials to be used for all hard surfaces shall be submitted to and agreed in writing by the Local Planning Authority prior to the commencement of the development. REASON: To reserve the rights of the Local Planning Authority with regard to these matters.
(11) A solid resistant surface in accordance with a scheme first agreed in writing with the Local Planning Authority shall be implemented in its entirety prior to the first occupation of any part of the development and shall be maintained. REASON: To achieve a satisfactory access way face where steep gradients are likely.
(12) A detailed tree survey shall be submitted for approval in writing to the Local Planning Authority together with details of any tree removal and proposed replacement trees prior to the commencement of any part of the development hereby approved. The approved scheme shall be implemented in its entirety and shall be maintained. REASON: To assure the continued presence of trees at this site.
(13) Prior to the commencement of works on site the necessary steps shall be taken to ensure that the lighting column within the visibility splay of the main access is relocated. REASON: In the interests of highway safety.
REASON FOR DECISION: The site is partly within the Brotton Conservation Area and part of the site is identified as an open area within that Conservation Area. Given the siting of the proposed dwellings it was considered that the proposal would have a neutral impact on the character and appearance of the area. Whilst trees will be removed to facilitate the development and the access, additional landscaping would mitigate the potential loss of trees. It was noted that the sight lines do not completely meet the design guidance. Given the fact that the access point will be widened and that the road was only serving three properties, it was considered that the level of traffic would not warrant refusal on highway grounds. The benefits of securing a long-term use for the site were recognised given the history of fly-tipping and vandalism on the site.
NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2, ENV4, ENV8, H2, H3 and T6 were relevant to this decision.
