| 1 | (1) The development hereby permitted shall be begun not later than the expiration of two years from the final approval of the reserved matters or, in the case of approval on different dates, the final approval of the last such matter to be approved. REASON : Required to be imposed pursuant to Section 92 of the Planning & Compulsory Purchase Act 2004. |
| 2 | (2) Approval of the details of the siting, design, and external appearance of the building(s), the means of access thereto and the landscaping of the site (hereinafter called "the reserved matters") shall be obtained from the Local Planning Authority before the expiration of three years from the date of this permission. REASON: To reserve the rights of the Local Planning Authority with regard to these matters. |
| 3 | (3) The proposed access road shall be at least 4.1 metres wide and incorporate a footway in accordance with a scheme to be agreed with the Local Planning Authority. REASON: In the interests of vehicular and pedestrian safety. |
| 4 | (4) Prior to the commencement of the use hereby approved a community use agreement shall be submitted to and approved in writing by the Local Planning Authority. The agreement shall include details of pricing policy, hours of use, management and maintenance. The plan shall then be implemented upon commencement of the use of the facility. REASON: To ensure a satisfactory form of development. |
| 5 | (5) Details of a revised School Travel Plan shall be agreed in writing with the Local Planning Authority before the use hereby approved commences. REASON: To ensure a satisfactory form of development. |
| 6 | (6) Details of the proposed cycle-parking arrangements shall be submitted to and agreed in writing with the Local Planning Authority and implemented in accordance with the agreed scheme prior to the use commencing. REASON: To ensure a satisfactory form of development. |
| 7 | REASON FOR DECISION: The outline application is for a new sixth-form facility at Nunthorpe School. Whilst some additional traffic will be generated extra parking will be provided within the site. Furthermore it is considered that the proposed development will only have a marginal impact on the highway network and therefore the scheme is acceptable in highway terms. The siting of the proposed unit is such that it will not have an unacceptable effect on the amenity of nearby residents. The position of the unit seeks to minimise the loss of playingfield area but allow maximum flexibility for any future redevelopment of the existing school. The sixth-form unit will enhance the educational facilities and reduce the travel distance for students. For these reasons the proposal is justified even though it constitutes a departure from the adopted Local Plan by virtue of the fact it is outside the limits to development. |
