# Condition Details
1 (1) The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
2 (2) The existing trees on Hill Crescent are to be retained unless otherwise agreed to in writing by the Local Planning Authority. REASON: To ensure that the existing tree line is retained.
3 (3) The existing trees on Dormer Crescent are to be selected for the healthier specimens and retained. Any other specimens should be replaces with a semi-mature specimen. REASON: To ensure that the existing tree line is retained.
4 REASON FOR DECISION: The application is for fencing, repaving, lighting and work to property boundaries at Hill Crescent and Dorman Crescent, Dormanstown. The proposal involves works to the existing trees, therefore the Council's arborist was asked to comment on the application. The response has recommended the retention of the original tree line on Hill Crescent with the exception of an ash tree, which may need to be felled to accommodate a corner shrub bed on the western side of Hill Crescent. It is recommended that the healthier trees on Dormer Crescent are selected and retained and that the poorer specimens (4) are replanted/replaced. The replaced trees are to be semi-mature specimens, so that they would better match the size of the existing established trees and be less vulnerable to vandalism. Therefore, it is considered that the proposed development has taken in to regard the road and open space layout of Dormanstown and will preserve the original form of the settlement. The proposal therefore complies with Policy ENV3 of the Council's Local Plan.
