| # | Condition Details |
|---|---|
(1) Approval of the details of the siting, design, and external appearance of the building(s), the means of access thereto and the landscaping of the site (hereinafter called "the reserved matters") shall be obtained from the Local Planning Authority before the expiration of three years from the date of this permission. REASON: To reserve the rights of the Local Planning Authority with regard to these matters.
(2) The development hereby permitted shall be begun not later than the expiration of two years from the final approval of the reserved matters or, in the case of approval on different dates, the final approval of the last such matter to be approved. REASON: Required to be imposed pursuant to Section 92 of the Planning and Compulsory Purchase Act 2004.
(3) Details of materials to be used on the external elevations of the development shall be submitted to and agreed in writing by the Local Planning Authority prior to the development being commenced. REASON: To ensure the use of satisfactory materials.
(4) No development shall take place until there has been submitted to, and agreed in writing by the Local Planning Authority, a scheme of landscaping which shall include indications of all existing trees and hedgerows on the land (if any), and details of any to be retained, together with measures for their protection in the course of the development. REASON: To reserve the rights of the Local Planning Authority with regard to these matters
(5) All planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting and seeding season following the occupation of the buildings or the completion of the development, whichever is sooner, and any trees or plants which within a period of five years from the completion of the development die, are removed, or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species unless the Local Planning Authority gives written consent to any variation. REASON: To ensure the satisfactory implementation of the approved scheme in the interests of the visual amenities of the locality.
(6) No development shall take place within the application site, until the applicant has secured the implementation of the off site highway improvement works, including the provision of protected right turning facilities, referred to in the application. REASON: In the interests of highway safety.
(7) Prior to the occupation of any part of the development hereby approved, boundary walls/fences shall be erected in accordance with a scheme that has first been agreed in writing with the Local Planning Authority and shall thereafter be maintained. REASON: In the interests of residential and visual amenity.
(8) Any facilities for the storage of oils, fuels or chemicals shall be sited on impervious bases and surrounded by impervious bund walls. The volume of the bunded compound should be at least equivalent to the capacity of the tank plus 10%. If there is multiple tankage, the compound should be at least equivalent to the capacity of the largest tank or the combined capacity of interconnected tanks, plus 10%. All filling points, vents, gauges and sight glasses must be located within the bund. The drainage system of the bund shall be sealed with no discharge to any watercourse, land or underground strata. Associated pipework should be located above ground and protected from accidental damage. All filling points and tank overflow pipe outlets should be detailed to discharge downwards into the bund. REASON: To prevent pollution of the water environment.
(9) Prior to the commencement of any works on site, a settlement facility for the removal of suspended solids from surface water run-offs during construction works shall be provided in accordance with details previously submitted to and approved in writing by the Local Planning Authority. The approved scheme shall be retained throughout the construction period. REASON: To prevent pollution of the water environment.
(10) No development shall be commenced until a scheme for the disposal of drainage has been submitted to and approved in writing by the Local Planning Authority. Thereafter no part of the development shall be occupied or brought into use until the approved scheme has been fully implemented. The scheme shall be retained throughout the life of the development unless otherwise agreed in writing with the Local Planning Authority. REASON: To prevent pollution of the water environment.
(11) Prior to the commencement of development at this site, a Flood Risk Assessment (FRA) shall be submitted to the Local Planning Authority for approval in writing. It shall demonstrate how surface water will be dealt with at this site. The recommendations of the approved document shall be adhered to in their entirety for the lifetime of the development. REASON: To meet recommended guidelines with regard to flood risk.
(12) A scheme for both the methods of dealing with drainage and sewerage at this site shall be submitted to the Local Planning Authority for approval in writing. The approved scheme shall be implemented in its entirety and thereafter be maintained. REASON: To ensure that a satisfactory method of drainage and sewerage disposal is achieved at this site.
(13) The detailed submission shall include details for a footpath/cycleway along the West Dyke Road frontage. REASON: To ensure adequate pedestrian/cycle infrastructure.
Informative Note: The application site is on/close to land that has been identified as having a history of potential contamination. It is not considered that the development proposed will give rise to 'significant risk' to health or pollution of controlled waters. It is recommended, however, that the attention of the applicant be drawn to the risk of contaminants in, on or under the site.
NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2, H3 and T6 were relevant to this decision.
REASON FOR DECISION: Outline planning permission is sought for residential development at the north end of the racecourse. All matters are reserved for future consideration. The site is within the limits of development as identified on the Proposals Map of the Local Plan. The site is close to existing residential development, local transport and well located for local services. The principle of residential development is acceptable. Due to its location the site is capable of being developed for residential purposes without detriment to the character and appearance of the area or the living conditions of any nearby residential occupiers. With regard to the highway aspects, the assessment submitted with the application documentation is reasonable. No harm to highway safety is therefore envisaged. Both the Environment Agency and Northumbrian Water have responded to consultation. Neither has objected to the proposals. It is therefore considered suitable conditions will ensure a satisfactory form of development is achieved. The issue of affordable provision has been assessed. It is concluded that as the Redcar Racecourse intend to invest the proceeds into the business and that this would benefit the town’s economy it would not be appropriate to require an affordable element in this instance.
